SUMMARY:Unraveling the Mysteries of Mixed Cases
DESCRIPTION:“Who wrote this statute? Somebody who takes pleasure in pulling wings off flies?” The process for handling mixed cases has confused and frustrated many EEO practitioners\, HR professionals\, agency attorneys\, and aggrieved employees – not to mention Supreme Court Justice Samuel Alito\, author of the aforementioned quote. \nIn this 60-minute virtual presentation\, the mystery of mixed cases will be unraveled.  You will learn to spot the potential issues early on in the process\, so you don’t waste valuable time and resources in the improper forum. Also discussed will be the interplay between the processes for grievances\, the EEOC\, and the MSPB; how to handle when a case is improperly identified at the time of acceptance\, but later realized; issuing amendments; untangling mixed cases when MSPB finds no jurisdiction; and every other path in the process. \nLearning objectives\n\nDiscuss procedural options for processing mixed cases.\nExplain the difference between a mixed case appeal and a mixed case complaint.\nIdentify potential jurisdictional issues in mixed case processing.\n\nEvent FAQs\nIs there any flexibility with course durations for Agency Direct training?  \nYes. Many agencies have requested that full-day courses be taught over two half-days to ensure maximum engagement\, especially when the course is being taught virtually. Any course can be spread out over multiple days or condensed into shorter sessions. And shorter classes can often be combined to build longer courses covering more topics. We’ll be happy to discuss the options that are most convenient to you. \nIn what format is this class held? \nThe class may be held onsite at an agency location\, or as a live virtual event.
