Webinar — Handling AWOL and Failure to Follow Leave Procedures
Apr 9 @ 1:00 pm – 2:00 pm

Course Description

It’s one of the situations most managers would most like to avoid — an employee who doesn’t show up for work. As agencies order some employees to return to the physical workplace, the chances an employee will not show up and not provide notice has increased. Is the best way to discipline the employee to charge him with AWOL?  What if he comes up with a reasonable explanation for his absence?  Can you deny a leave request when an employee was AWOL? Part of the Managing the Federal Workplace in 2024: Dos and Don’ts for Supervisors webinar series, this class will give you all of the tools and knowledge you need to successfully and confidently respond when employees fail to follow leave procedures.

Attendees will learn how to:

  • Hold employees accountable when they don’t show up for work.
  • Properly use an AWOL charge.
  • Expand knowledge of leave procedures.

Virtual Training Event – Drafting Enforceable and Legally Sufficient Settlement Agreements
Apr 10 @ 1:00 pm – 4:30 pm

Course Description

Most disputes in federal agencies settle employment disputes — whether they initiate as grievances, EEO complaints, or as appeals of agency disciplinary actions. While it’s common to assume that settlement means the agency has a flaw in its case, it has no direct tie to liability or admissions of wrongdoing. Often, it’s the most efficient and effective way to handle a dispute and allow you to get back to focusing on your agency’s mission.

During this interactive half-day virtual training, Bob Woods will discuss the roles and responsibilities of individuals involved in settlement discussions, and will cover considerations for why and when to consider settlement as an option. In addition, he’ll explain concepts including confidentiality, legality, and enforceability.

Mr. Woods will also cover specific settlement terms that may be negotiated including references, compensatory damages, reinstatement or promotions, modifications to benefits, clean records, and more.

Learning objectives

Attendees will learn how to:

  • Implement best practices in drafting plain language agreements.
  • Structure a possible agreement.
  • Identify the limits on settlement terms.

Plus, you’ll have opportunities to ask questions. The training will run from 1 – 4:30 pm ET, with 10 minute breaks throughout.

Date and Time

Wednesday, April 10, 2024, 1:00 – 4:30 pm eastern.

Webinar – Do You Really Know How to Use the Douglas Factors?
Apr 23 @ 1:00 pm – 2:00 pm

Course Description

It’s been over 40 years since we were all introduced to those 12 factors identified in the Merit System Protection Board’s landmark Douglas v. VA decision, the most cited case in Federal employment law. But you don’t have to go back to the Reagan Administration to find examples of agencies’ misunderstanding and/or misapplying those factors.

Just look at a any recent batch of MSPB decisions and you’ll find continued confusion about how to appropriately determine a penalty – and clarity from the Board about their view on Douglas.

Instructor and attorney Ann Boehm will share recent case law, highlighting how agencies correctly use the Douglas factors and also how they have been misapplied. She will answer all your Douglas questions, such as: Do the factors go in the proposal or the decision? What do OPM’s new regs say about the Douglas factors? What’s the best way to prevent penalty mitigation?

Learning takeaways

Attendees will learn how to:

  • Understand the Douglas factors principles
  • Explain when and how to use each factor
  • Avoid the too-common Douglas mistakes that sink your case

Virtual Training Event – Conducting Effective Harassment Investigations
Apr 30 – May 2 all-day

Course Description

Investigating harassment in your Federal agency can be an intimidating assignment, one that is rife with innuendo, conflicting accounts, and raw emotions. Ensuring that your investigation is legally compliant and protects employees, while helping the agency minimize liability, is a taxing task.

Together, these three instructor-led live training sessions will provide a solid basis for a successful and effective approach to conducting legally sufficient harassment investigations that stand up upon third-party review. Peruse MSPB and EEOC cases and you’ll find that poorly conducted investigations are far more common than they should be, and the cost of these investigations to agencies are bigger than you’d expect.

Understand the differences between EEO and non-EEO harassment. Learn the best techniques to conduct an investigation – whether onsite or virtually. Write a report that covers all the crucial information. Learn to conduct investigations virtually, as more are done since the pandemic. And much more.

This open enrollment FELTG Virtual Training Institute program Conducting Effective Harassment Investigations offers opportunities to ask questions of FELTG’s experienced instructors, and get answers in real time. Plus, this program fulfills the requirements for 8-hour annual EEO investigator refresher training.

You can register for any of the sessions individually, or you can register for all three. This program runs from 1:00 – 4:30 eastern each day, with a 30-minute break midway.

Webinar — How to Use a PIP in 2024
May 7 @ 1:00 pm – 2:00 pm

Course Description

Federal supervisors have a useful tool to deal with underperforming employees – the Performance Improvement Plan (PIP). Yet, supervisors have consistently struggled with getting PIPs right. And then came the decision in Santos v. NASA, which requires agencies to have substantial evidence of poor performance BEFORE the implementing the PIP. Part of the Managing the Federal Workplace in 2024: Dos and Don’ts for Supervisors webinar series, this class will detail the ins and outs of this requirement and share clear guidance and the effective, time-tested FELTG approach to handling unacceptable performance in 2024.

Attendees will learn how to:

  • Gather the information needed prior the PIP process.
  • Discern the difference between substantial and other types of evidence.
  • Confidently handle unacceptable performance through the use of PIPs.

Virtual Training Event – All Clear? When Employee Security Clearances are Revoked or Suspended
May 14 @ 1:00 pm – 3:00 pm

Course Description

If a federal employee is required to have access to classified information, then the employee must be eligible for a security clearance in order to keep that position. What happens when that employee no longer has that clearance? What role does the MSPB play? What proof does the agency need to provide if the employee appeals a removal? What are the pitfalls that agencies need to avoid?

During this two-hour virtual event, Ann Boehm will detail how to handle a security clearance revocation and any resulting indefinite suspension or removal from employment. Ms. Boehm spent 26 years as a government attorney, focusing primarily on employment and labor law in federal enforcement agencies, so she’s just the person to answer any questions you might have – and she’ll do so in this live event.

This is an important topic that can’t be ignored. Employee security clearances are a matter of national security, and they must be handled appropriately.

Attendees will learn how to:

  • Identify and understand the executive orders pertaining to national security.
  • Understand the National Security Adjudicative Guidelines.
  • Recognize the agency’s burden when removing or suspending for failure to maintain a security clearance.

Virtual Training Event – Clean Records, Last Rites, Last Chances, and Other Discipline Alternatives
May 21 @ 1:00 pm – 3:00 pm

Course Description

If you’ve attended FELTG accountability training, you know the numerous pitfalls that can derail an agency’s disciplinary action, whether it’s suspension, demotion, or removal. But even when executed correctly, traditional discipline can sometimes make a bad situation worse. For example: You suspend an employee and create more work for everyone else on the team. Sometimes, the most “effective and efficient” approach is not a traditional disciplinary action. Late last year, OPM issued regulations that removed a prohibition on clean record agreements, returning to agencies a tool “to resolve informal and formal complaints.” It is one of many alternative disciplinary tools Federal supervisors have. In this two-hour virtual training, FELTG Instructor Deborah J. Hopkins will explain why, how, and when to use numerous alternative actions, including not just clean record agreements, but also:

  • Last chance agreements
  • Last rites agreements
  • Paper suspensions
  • Reprimands in lieu of suspensions
  • And more

The goal of discipline is to rehabilitate. In certain circumstances, alternative sanctions are the more effective approach. You’ll leave this session knowing how to identify the right disciplinary alternative for your situation and the appropriate steps to see it all the way through successfully. Attendees will learn how to:

  • Appropriately draft documents for alternative discipline.
  • Explain the difference between last chance agreements and last rites agreements.
  • Discuss the benefits of reprimand in lieu of suspension.

Virtual Training Event – Writing Final Agency Decisions
May 22 – May 23 all-day

Course Description

Final Agency Decision sounds so, well, “final.” But it most definitely is not. A FAD is appealable, by the complainant, to the EEOC. And many employees have and will continue to take advantage of that opportunity to appeal the agency’s decision. And here’s the thing: The EEOC’s decisions are filled with reversals of the agency’s FAD, finding no discrimination.

How do you avoid such a disappointing decision?

Learn how to write an effective final agency decision. To do that requires a knowing and understanding of discrimination law, as it is uniquely applied to the Federal workplace.

That’s what FELTG Instructor and Attorney at Law Katherine Atkinson will teach you over two half-days of virtual training. Attendees will leave with all they need to know to write an effective FAD, including identifying and avoiding the pitfalls that often lead to the EEOC reversals that plague so many EEO professionals.

This program meets the President’s mandate to provide training on diversity, equity, inclusion and accessibility in the Federal workplace.

Wednesday, May 22

Applying Theories of Discrimination: EEO Law Overview; Intentional Discrimination; Disparate Impact; Hostile Work Environment; Reasonable Accommodation; Retaliation; Overlapping Forms of Discrimination.

Thursday, May 23

Writing the Report: Timeliness Issues; Effective Legal Writing: structure and language; FAD Legal Sufficiency; Deconstruction Exercise.

Virtual Training Event – Advanced EEO: Navigating Complex Issues
Jul 16 – Jul 18 all-day

Course Description

A supervisor sees his employee going into an investigation interview and says, “Just don’t play the race card.” An employee, who was provided new software as a reasonable accommodation, tells you weeks later that her computer has “been glitchy” since the new software was added.

When EEO challenges arise, they rarely show up as run-of-the-mill simple scenarios you’ve worked through in a training class. Are you an EEO professional, attorney or advisor eager to learn how to more effectively manage the unexpected EEO issues? Are you looking for guidance to answer challenging questions, such as: Can an agency be held liable for retaliation in a disciplinary action if the deciding official was unaware of the employee’s prior protected activity? Virtual Training Event – Nondiscriminatory Hiring in the Federal Workplace: Advancing Diversity, Equity, Inclusion and Accessibility
Aug 28 @ 1:00 pm – 4:30 pm

Course Description

The Federal hiring process is a challenging one that requires patience. Those who hurry the hiring process are not only likely to make a mistake in hiring, but they may also end up without sufficient documentation to combat a discrimination complaint, making the allegation difficult to defend against.

And there is NO excuse these days for having any steps in your hiring process that could be discriminatory. Per Executive Order, your agency should have already taken steps to “advance diversity, equity, inclusion, and accessibility,” and “eliminate, where applicable, barriers to equity, in Federal workforce functions.”

Regardless of where you are in the development of an agency Diversity, Equity, Inclusion, and Accessibility (DEIA) plan or whether your agency is even currently hiring, this half-day virtual training provides important guidance that you cannot afford to miss if you want to ensure your hiring practices are nondiscriminatory and align with the Federal merit system principles.

FELTG instructor and attorney at law Katherine Atkinson will explain the types of interview questions that cause problems, and discuss selection panel roles and responsibilities, including ensuring the selecting officials implement best practices to develop and maintain evidence, demonstrating the non-selection was neither discriminatory nor retaliatory.

Attend from wherever you are working — agency office or home. The program will be presented live, and you’ll have time to ask questions and get answers in real time. This program runs from 1:00 – 4:30 pm eastern, with a 30-minute break midway.

This program meets the President’s mandate to provide training on diversity, equity, inclusion and accessibility in the Federal workplace.

Virtual Training Event – Conducting Effective Harassment Investigations
Oct 1 – Oct 3 all-day

Tuesday, October 1, 2024

Virtual Training Event – Get it Right the First Time: Accepting, Dismissing and Framing EEO Claims
Oct 30 – Oct 31 all-day

Course Description

It could be a timeliness issue, failure to state a claim, or something else. Sometimes your agency has a responsibility to dismiss an EEO complaint. However, you do so at your own risk. A surprisingly large number of agency dismissals are overturned by the EEOC each year – and a remand years after the events in question can equal big problems when it comes to the investigation.

How do you balance the obligation to dismiss faulty complaints without unlawfully stripping someone of their rights to the EEO process and ending up on the wrong side of an EEOC decision in the process?

Join FELTG Instructor Katherine Atkinson for this two-day look into the core of the complaint process — determining whether to accept or dismiss an EEO claim. Ms. Atkinson will review the lawful reasons for dismissing a claim and how to make that determination. She’ll also take you through the process of spotting and framing claims based on each of the theories of discrimination.

This class will have interactive polling and plenty of opportunities to ask specific questions. And before the training ends, you’ll participate in an exercise to refresh what you’ve learned about acceptance/dismissal.

Attendees will leave with guidance and tools for identifying claims that do not fall under the EEO process, understanding the various components of timeliness in EEO claims, and drafting a legally sufficient acceptance and dismissal document.

Wednesday, October 30

Topics covered: Bases to dismiss claims; claim fragmentation; role of the EEO counselor’s report; legally protected categories under the EEOC’s jurisdiction; spotting and framing intentional discrimination claims; spotting and framing disparate impact claims; spotting and framing hostile work environment claims; spotting and framing reasonable accommodation claims; spotting and framing other ADA/Rehabilitation Act causes of action.

Thursday, October 31

Topics covered: Spotting and framing reprisal claims, including per se retaliation; timeliness principles; contractor EEO complaints.

Virtual Training Event – Writing Final Agency Decisions
Nov 19 – Nov 20 all-day

Tuesday, November 19, 2024

Applying Theories of Discrimination: EEO Law Overview; Intentional Discrimination; Disparate Impact; Hostile Work Environment; Reasonable Accommodation; Retaliation; Overlapping Forms of Discrimination.

Wednesday, November 20, 2024

Writing the Report: Timeliness Issues; Effective Legal Writing: structure and language; FAD Legal Sufficiency; Deconstruction Exercise.
