Event Description

Investigating harassment in your agency can be an intimidating assignment, one that is rife with innuendo, conflicting accounts, and raw emotions. Ensuring that your investigation is legally compliant and protects employees, while helping the agency minimize liability, is a taxing task. Together, these three instructor-led live training sessions will provide a solid basis for a successful and effective approach to conducting legally-sufficient harassment investigations that stand up upon third-party review. Session 2: Understanding Harassment and Planning the Investigation

Course description: What is the scope of the investigation? Who should you interview? What documents are you going to need? Preparing your investigative plan is a critical step in developing a legally sufficient investigation. Attorney Katherine Atkinson will explain the proper role of the investigator and how you can avoid the pitfalls of an insufficient investigation with the proper preparation and knowledge. Plus, she’ll answer important questions about representation: Does the witness have the right to a representative? Does the union have a right to attend the interview – even if the witness doesn’t want the union there? What rights does agency management have in the process?

Course description: Attorney Meghan Droste will share legal principles and proven guidance to navigate this most critical and challenging part of harassment investigations: conducting the interviews and gathering relevant evidence. Attendees will leave the session with techniques for questioning, tools for reading body language, suggestions on how to handle difficult personality types, and tips for writing the fact-finding report (FFR) and report of investigation (ROI). Ms. Droste will also share how technology is changing the investigation process, including a very timely discussion of conducting virtual interviews.

Holding federal employees accountable for performance and conduct is easier than you might think. Too many supervisors believe that an employee’s protected activity (EEO complaints, whistleblower disclosures, or union activity) precludes the supervisor from initiating a suspension or removal, but that’s just not true. During the COVID-19 pandemic, it’s even more imperative your employees are doing the work they are assigned to do, and following all workplace rules along the way.

FELTG is here to make federal supervisors’ and advisers’ lives easier by clarifying those misconceptions while helping supervisors understand how to take defensible misconduct actions quickly and fairly – actions that withstand scrutiny on appeal by the MSPB, EEOC, or in grievance arbitration. Session 2: Accountability for Conduct and Performance, Part II

Course Description: This session begins with a focus on one of the most misunderstood areas of accountability: poor performance. The conversation includes the requirements to implement a performance demonstration period, initiating and completing a performance-based action, and determining the appropriate outcome after the employee has been given an opportunity to demonstrate acceptable performance. From there, the discussion turns to some tricky supervisory scenarios that become less intimidating after explanation: dealing with attendance issues, properly handling the absent employee, medical removals and dealing with union issues.

Session 3: Defending Against Discrimination Complaints: The Supervisor’s Role in EEO

Course Description: One of the most intimidating experiences for a federal supervisor is being named in an EEO complaint. Yet, if you are a supervisor for any length of time, there’s a good chance it will happen. This session helps to clarify the federal EEO process so supervisors understand how defend against allegations of discrimination. After an explanation of the protected EEO categories, we’ll cover what to do – and what not to do – if you’re a Responding Management Official in a complaint, and what happens if you’re called as an EEO witness. From there, the program will cover the theories of discrimination, and will provide you with the tools you need to prove your workplace actions were legitimate and non-discriminatory. You’ll sleep better at night after attending this session!

The workplace has been turned upside down over the last several months, as more than a million federal employees left their desks and agency facilities to work from home. Some agencies are ordering employees back to their offices and facilities while others are teleworking long-term. Although fewer people are working in the office, EEO problems have not vanished. Event Description

This week focuses on conducting administrative investigations in the federal workplace with an emphasis on employee misconduct including workplace harassment. After an overview of the substantive law, participants will learn procedures and best practices for conducting investigations in the federal workplace, including planning the investigation, factfinding, collecting evidence, dealing with witnesses, understanding types of questioning, and testifying at hearing. The week concludes with a day focused on writing an investigative report.

This program fulfills the requirements for 32-hour EEO Investigator training and 8-hour annual EEO investigator refresher training.

Virtual Training Event – Leave and Attendance 2020: EPSLA, FMLA, PPL, and Related Topics

Rules about attendance have changed dramatically since the beginning of the COVID-19 pandemic. The Emergency Paid Sick Leave Act (EPSLA) provides a new form of leave for Federal employees infected, quarantined, or required to fulfill caregiving responsibilities. Paid Parental Leave (PPL) is now in effect, and many practitioners have questions about exactly how this leave will work. FMLA regulations were modified concurrently with the issuance of the PPL regulations and that will require adjustments to how FMLA is managed. Weather and Safety Leave has been used in ways no one has ever seen before, and there are also workers’ compensation issues if employees are infected through their employment.

HR specialists, agency attorneys and supervisors are on the hot seat to answer questions about these various attendance issues and types of leave – and to deal with unions about the requirements for implementation of these types of leave, potential claims that EPSLA was violated, grievances about FMLA and PPL, and more.

During this half-day virtual training event, Barbara Haga will provide answers to questions such as:

  • What are the uses for EPSLA and what documentation must be provided for those uses?
  • Could an employee become eligible for PPL after the date of birth or placement?

Almost 18 percent of all adults have a mental illness diagnosis at some point in their lives. The COVID-19 pandemic has exacerbated the ongoing mental health crisis in this country. Meanwhile, much of the federal workplace is struggling with new work processes and heightened responsibilities, especially those working directly on the pandemic while navigating political minefields.

This virtual training program will provide highly practical guidance and straight-forward advice on dealing with the very unique challenges you face at this time. Licensed Clinical Social Work Shana Palmieri will de-stigmatize the truth about “mental illness” and will explain the impact various mental health conditions have on individuals, and those they work with. Aside from completing a comprehensive OIG strategic plan, annual planning with robust outreach to your stakeholders is the single most important thing an OIG does. When properly executed, OIG annual planning focuses your personnel, time, budget, and oversight resources on the issues that really matter to your Agency and the accomplishment of its fundamental missions. We all have limited resources. Therefore, it is imperative that OIGs also conduct continual stakeholder outreach to understand what challenges impede their mission. FELTG Instructor Scott Boehm, whose federal career included a stint benchmarking for Best Practices within the Council of the Inspectors General on Integrity and Efficiency (CIGIE), will walk you through the five-step annual planning and outreach process while discussing elusive OIG and Agency data sources that too many OIGs overlook.

Every Office of Inspector General should also periodically conduct benchmarking for Best Practices with other OIGs. No OIG has all the answers or “perfect internal controls” and should, therefore, regularly seek better business practices from peer organizations. In fact, both the “Silver Book” for federal, and the “Green Book” for state and local OIGs, state: “OIGs should strive to conduct their operation in the most efficient and effective manner. Each OIG should manage available resources, at the least cost, to produce the greatest results in terms of public benefit, return on investment, and risk reduction.”

Benchmarking ensures your limited OIG resources – budgets, personnel, supplies, infrastructure, training, and time – are focused on the issues that really matter to your Agency.

Attendees will leave this session with a template for OIG annual planning and outreach, complete with stakeholder questions that will reduce agency risk and maximize OIG return on investment (ROI), as well as an OIG benchmarking template that can improve your OIG’s annual planning process; audit, investigation and evaluation handbooks; product lines and report production; return on investment (ROI); and follow-up processes.

Managing the uncertainty and increased workload when employees are absent has always been a challenge for federal HR professionals, Employee Relations specialists, and supervisors. Absence doesn’t just occur when an employee is sick. Federal employees enjoy a host of leave-related entitlements, including a large swath of leave tied to family member medical conditions, including sick leave and FMLA. With FMLA, the employee may substitute paid leave, and now with the Federal Employee Paid Leave Act, employees have another type of leave to cover birth and placement. It can all seem quite confusing, but FELTG is here to help.

As rioters stormed the Capitol on January 6, it was the heroic actions of an under-staffed Capitol Police team that likely saved numerous lives, including those of many Members of Congress and their staff. Unfortunately, the lives of two Capitol officers have been lost.

The Federal workforce is full of talented and brave law enforcement personnel across many agencies. Yet, just as there is a small minority of misbehaving and toxic Federal workers, the same applies to Federal LEOs. In fact, a number of Federal LEOs have been suspended and others are being investigated as a result of their actions during the riot. And after reports of police officers being identified among the rioters, the promises to be deeper investigations into the infiltration of Federal and non-Federal officers affiliated with hate and white supremacy groups.

This creates a lot of questions regarding LEO conduct:

  • How do conduct standards for LEOs differ from other employees?
  • Are conduct standards for IG employees the same as other LEOs?
  • What kinds of conduct could cause an LEO to have a security clearance revoked?
  • When should an agency consider an indefinite suspensions and invoking the crime provision?
  • What proof does the agency need to provide if the employee appeals her removal?

Managing the uncertainty and increased workload when employees are absent has always been a challenge for federal HR professionals, Employee Relations specialists, and supervisors. Absence doesn’t just occur when an employee is sick. Federal employees enjoy a host of leave-related entitlements, including a large swath of leave tied to family member medical conditions, including sick leave and FMLA. With FMLA, the employee may substitute paid leave, and now with the Federal Employee Paid Leave Act, employees have another type of leave to cover birth and placement. It can all seem quite confusing, but FELTG is here to help.

More Americans are receiving COVID-19 vaccinations each day. But while the vaccine is helping eradicate the virus, it hasn’t put an end to pandemic-related EEO challenges. If anything, the increased availability of the COVID vaccines has created some new and even more difficult EEO quandaries.

Attorney Katherine Atkinson helped FELTG customers navigate these uncharted waters in 2020, and now she returns with more answers and the latest available guidance, including how to respond to employees who won’t take the vaccine due to disability, or religious reasons.

No doubt about it. The federal workplace was turned upside down in 2020 as more than a million employees suddenly became full-time teleworkers. While employees vanished from the physical workplace, EEO problems did not.  Meanwhile, EEO issues rose for health care providers, security officers, law enforcement officials, and other essential workers. These EEO problems have gotten more challenging — and many of the situations arising have no legal precedent.

Ms. Atkinson will explain how applying the basic EEO framework can answer the aforementioned and other puzzling EEO questions you may suddenly face. Because Ms. Atkinson will use a legal analysis to address these challenges, the answers and guidance you receive during this virtual training will be useful long after the coronavirus is gone.

All Offices of Inspectors General (OIGs) have mandated quality standards and are expected to conduct their operation in the most efficient and effective manner. Each OIG is expected to manage available resources, at the least cost, to “produce the greatest results in terms of public benefit, return on investment, and risk reduction.”

OIGs cannot accomplish this mission if they lack a robust strategic planning process. Because OIGs continually examine their Agency’s internal controls for efficiency and effectiveness, they must also periodically examine their own. Every three to five years, OIGs should conduct a strategic planning process and publish a revised OIG strategic plan. Strategic planning ensures that your OIG resources (budgets, personnel, infrastructure, training, and time) are focused on accomplishing the mission, reducing risk, and maximizing return on investment (ROI) and public benefit.

FELTG Instructor Scott Boehm will kick off this virtual training with a thorough review of the strategic planning process, complete with examples from his federal OIG experience. He will then tailor the process to address the specific requirements of all OIGs.  This include clarifying the methodology, participants and their contributions, pre-session inputs, deliverables and timelines. He will discuss the OIG’s “Values Scan” and then the “Mandate Analysis” that gives the office its statutory or administrative authorities.  He will also show how to formulate the OIG Mission Statement while reviewing the higher-level Agency’s strategic plan.

The training will include a discussion of Strengths, Weaknesses, Opportunities and Threats (SWOT) analysis, IG Vision formulation.  Attendees will learn how to formulate the plan of actions and milestones (POA&M) and develop metrics. Attendees will learn:

  • The definitions of questioned costs, unsupported costs, disallowed costs, and funds put to better use
  • New strategies for computing their return on investment for audits, inspections and evaluations
  • “Other Impact” categories that can, and have been, monetized by federal OIGs in the past

And you’ll have multiple opportunities to ask questions – and get answers in real time – as you develop a complete methodology to measure ROI for your OIG. This program runs from 12:30 – 4:30 eastern, with a 30-minute break from 2:15 – 2:45 eastern.

On his first day in office, President Biden took action to advance racial equity through the federal government and strengthen workplace discrimination protections based on sexual orientation and gender identity. It’s up to each agency now to ensure that it lives up to the President’s direction. Policies and procedures alone will not work. Employees, regardless of race, color, religion, gender identity or sexual orientation, will not feel respected and empowered unless the agency addresses unconscious bias and microaggressions in the workplace.

A microaggression is a comment or action that either intentionally or accidentally targets a marginalized individual or group of people.  If a supervisor or coworker commits a microaggression accidentally, it’s not that big of deal, right? It can’t be bad if the comment was meant as a compliment? No harm, no foul? Wrong. Wrong. Wrong. Microaggressions, whether intentional or not, can be very hurtful to the employees who experience them, and such behaviors indicating implicit bias can lead to discrimination. They are warning signs of a potential hostile workplace. And they put a serious dent in employee morale and productivity.

During this two-hour virtual training, FELTG Instructor Meghan Droste, attorney at law, will explain what microaggressions look like it in their various forms — microinsults, microassaults, and microinvalidations. Ms. Droste will share an implicit bias test, explain its impact, and provide examples. She’ll provide a quick review of EEO law so you can determine when bias or microaggression leads to the level of discrimination.

This is important training for supervisors, EEO specialists, HR practitioners, and employees in general.

Federal employees enjoy a wide variety of leave-related benefits. However, many of us would never use the words “enjoy” and “leave” so closely together. Whether you’re an HR professional, employee relations practitioner, EEO specialist, supervisor, or agency counsel, you have undoubtedly faced a leave-related challenge. FELTG’s Absence, Leave Abuse & Medical Issues Week will give you the critical foundation you need to address the most complex areas of federal employment law, including the recent challenges related to the COVID-19 pandemic.

Our speakers will discuss sick leave, annual leave, leave without pay, absence without leave, and FMLA. Course Description: You likely know those 12 factors identified in the landmark 1981 MSPB decision that birthed their name. But do you know how to use them to determine the appropriate penalty? Attorney Ann Boehm will share case law highlighting how agencies correctly use the Douglas factors and, more importantly, how they were misapplied. She will answer all your Douglas questions, such as: Do the factors go in the proposal or the decision? What do OPM’s new regs say about the Douglas factors? In light of the Accountability Act, does the VA still have to do Douglas factors? Attendees will leave this session with the knowledge to avoid the too-common Douglas mistakes. The Roller Coaster Employee: Managing Up-and-Down Performance

An employee is put on a performance demonstration period (DP, PIP, ODAP – or whatever your agency calls it) and does well enough to stay in his position. When Employees Go Insubordinate: Don’t Mess With the Wrong Elements

That may sound like a good definition of insubordination for Webster’s Dictionary, but it’s not going to work for the MSPB.  Charges of workplace misconduct have specific legal definitions, which include elements. And to prove a charge, you need to prove all of its elements. FELTG President Deborah Hopkins will walk you through the elements of insubordination and the factors that determine how to best deal with employees who disobey, or refuse to follow, management orders. Preventing and Correcting Hostile Work Environment Harassment

Course description: Not all hostile work environment cases involve sexual harassment. However, as attorney Meghan Droste will show you, a large majority do. And yet, hostile environment harassment is often alleged based on all of the protected categories –  sex, race, color, national origin, religion, age, disability, genetic information, or reprisal. Ms. Droste will define the “nature of the conduct,” as well as the “unwelcome” and the “sufficiently severe or pervasive” requirements. She’ll also discuss agency and supervisor liability, share successful prevention techniques, and the provisions of Executive Order 13985 and 13988 that apply to Federal agencies. Barking Up the Wrong Tree? Service and Therapy Animals in the Workspace

Course description: Pet ownership increased and animal shelters emptied during COVID-enforced lockdowns in 2020. Undoubtedly, remote workers have enjoyed the therapeutic benefits that come with owning a pet. But does that make their new furry friends therapy or emotional support animals? And can no-longer-remote employees bring their new four-legged friends to the workplace? In most cases, the answer is an easy no. But if it’s a reasonable accommodation request, the answer isn’t quite as definitive. The EEOC’s stance that an emotional support animal may be a required reasonable accommodation for a qualified individual with a disability, even if it is not a trained service dog, fails to provide an easy answer. FELTG President Deborah Hopkins will explain the difference between a service animal and a therapy animal, and provide guidance on how to determine if an emotional support animal would be a reasonable accommodation for an individual with a disability. Course description: A federal contractor may file a formal EEO complaint if the agency is determined to be a “joint employer.” How do you determine if you are a joint employer? That determination begins with the case Ma v. HHS. Attorney Bob Woods will walk you through how to apply the Ma factors to your situation. Impact and Implementation Bargaining in the Federal Workplace

Course description: When an agency makes a change, it may trigger an obligation to negotiate. In late 2020, however, the Federal Labor Relations Authority released three precedent-breaking decisions that pushed the reset button on bargaining with unions. The Authority’s decision in U.S. Department of Education, in particular, seriously diluted that management obligation to negotiate. GEAR initiative and other efforts focused on modifying Federal performance management system. Linkage between appraisal and other personnel management decisions, including reduction-in-force and within-grade increases. Writing effective and measurable performance criteria that will withstand third-party review, including a workshop where participants will do an in-depth review of performance plans. Requirements for successful performance-based actions – from drafting a PIP notice that will withstand scrutiny to conducting a bona fide PIP to ensuring that due process is met in effecting an action on unacceptable performance.

More Americans are receiving COVID-19 vaccinations each day. But while the vaccine is helping eradicate the virus, it hasn’t put an end to pandemic-related EEO challenges. If anything, the increased availability of the COVID vaccines has created some new and even more difficult EEO quandaries.

Attorney Katherine Atkinson helped FELTG customers navigate these uncharted waters in 2020, and now she returns with more answers and the latest available guidance, including how to respond to employees who won’t take the vaccine due to disability, or religious reasons.

No doubt about it. The federal workplace was turned upside down in 2020 as more than a million employees suddenly became full-time teleworkers. While employees vanished from the physical workplace, EEO problems did not.  Meanwhile, EEO issues rose for health care providers, security officers, law enforcement officials, and other essential workers. These EEO problems have gotten more challenging — and many of the situations arising have no legal precedent.

Ms. Atkinson will explain how applying the basic EEO framework can answer the aforementioned and other puzzling EEO questions you may suddenly face. Because Ms. Atkinson will use a legal analysis to address these challenges, the answers and guidance you receive during this virtual training will be useful long after the coronavirus is gone.

  • What if an employee refuses to take the vaccine, but is also not in a position that can be done remotely?

The federal hiring process requires patience. If you’ve finally been granted approval to fill a position, you may be tempted to get someone hired as quickly as possible. But, wait just a moment.  Take the time to do it correctly. Those who hurry the hiring process are not only likely to make a mistake in hiring, but they may also end up without sufficient documentation to combat a discrimination complaint, making the allegation difficult to defend against. And after a flurry of Executive Orders early in his term, President Biden has made it clear that diversity and inclusion are priorities in the federal workplace.

At some point in your career, you’ve likely had a case where an employee alleges that she was not selected or promoted because of something other than job qualifications – race, sex, age, disability, or another protected class. These cases may be common, but that they’re not routine. If not handled correctly, they can impact your hiring processes and damage morale.

FELTG instructor and attorney at law Meghan Droste will explain how to ensure your hiring practices are nondiscriminatory and align with merit system principles. Ms. Droste will cover the kinds of interview questions that cause problems, and will discuss selection panel roles and responsibilities, including ensuring the selecting officials implement best practices to develop and maintain evidence demonstrating the non-selection was neither discriminatory nor retaliatory.
