Litigating cases in federal sector employment law is a unique prospect, and isn’t for the unprepared. In addition, taking a case to arbitration is also a world of its own. This half-day virtual class focuses on providing tips to practice effectively and successfully in administrative hearings before the EEOC, MSPB, and in arbitration. Learn the similarities and differences between these forums, how to get organized for the hearing, and the techniques of effective direct- and cross-examination, and gain insight to the thought processes of the adjudicators. During this 60-minute webinar, FELTG Senior Instructor Barbara Haga will share the details practitioners need regarding implementation and use of paid time off for childbirth, adoption, and foster care under the provisions of the Federal Employee Paid Leave Act, which are effective on October 1, 2020. Ms. Haga will focus eligibility, computing the number of hours an employee may be paid for, the length of time the employee has to use the leave, and notification procedures. Attendees will learn about return to work agreements and the enforcement of those agreements.

Attendees will also learn how to:

  • Explain all of the conditions that determine when a parent is eligible to utilize the paid leave.
  • Identify when the leave may be used after the son or daughter is born or placed.

Event Description

This week focuses on conducting administrative investigations in the federal workplace with an emphasis on employee misconduct including workplace harassment. Virtual Training Event – Leave and Attendance 2020: EPSLA, FMLA, PPL, and Related Topics

Rules about attendance have changed dramatically since the beginning of the COVID-19 pandemic. The Emergency Paid Sick Leave Act (EPSLA) provides a new form of leave for Federal employees infected, quarantined, or required to fulfill caregiving responsibilities. Paid Parental Leave (PPL) is now in effect, and many practitioners have questions about exactly how this leave will work. FMLA regulations were modified concurrently with the issuance of the PPL regulations and that will require adjustments to how FMLA is managed. Weather and Safety Leave has been used in ways no one has ever seen before, and there are also workers’ compensation issues if employees are infected through their employment.

HR specialists, agency attorneys and supervisors are on the hot seat to answer questions about these various attendance issues and types of leave – and to deal with unions about the requirements for implementation of these types of leave, potential claims that EPSLA was violated, grievances about FMLA and PPL, and more.

During this half-day virtual training event, Barbara Haga will provide answers to questions such as:

  • What are the uses for EPSLA and what documentation must be provided for those uses?
  • Could an employee become eligible for PPL after the date of birth or placement?

When properly executed, OIG annual planning focuses your personnel, time, budget, and oversight resources on the issues that really matter to your Agency and the accomplishment of its fundamental missions. Almost 18 percent of all adults have a mental illness diagnosis at some point in their lives. The COVID-19 pandemic has exacerbated the ongoing mental health crisis in this country. Meanwhile, much of the federal workplace is struggling with new work processes and heightened responsibilities, especially those working directly on the pandemic while navigating political minefields.

This virtual training program will provide highly practical guidance and straight-forward advice on dealing with the very unique challenges you face at this time. Licensed Clinical Social Work Shana Palmieri will de-stigmatize the truth about “mental illness” and will explain the impact various mental health conditions have on individuals, and those they work with. Aside from completing a comprehensive OIG strategic plan, annual planning with robust outreach to your stakeholders is the single most important thing an OIG does. When properly executed, OIG annual planning focuses your personnel, time, budget, and oversight resources on the issues that really matter to your Agency and the accomplishment of its fundamental missions. We all have limited resources. Therefore, it is imperative that OIGs also conduct continual stakeholder outreach to understand what challenges impede their mission. FELTG Instructor Scott Boehm, whose federal career included a stint benchmarking for Best Practices within the Council of the Inspectors General on Integrity and Efficiency (CIGIE), will walk you through the five-step annual planning and outreach process while discussing elusive OIG and Agency data sources that too many OIGs overlook.

Every Office of Inspector General should also periodically conduct benchmarking for Best Practices with other OIGs. No OIG has all the answers or “perfect internal controls” and should, therefore, regularly seek better business practices from peer organizations. In fact, both the “Silver Book” for federal, and the “Green Book” for state and local OIGs, state: “OIGs should strive to conduct their operation in the most efficient and effective manner. Each OIG should manage available resources, at the least cost, to produce the greatest results in terms of public benefit, return on investment, and risk reduction.”

Benchmarking ensures your limited OIG resources – budgets, personnel, supplies, infrastructure, training, and time – are focused on the issues that really matter to your Agency.

Managing the uncertainty and increased workload when employees are absent has always been a challenge for federal HR professionals, Employee Relations specialists, and supervisors. Absence doesn’t just occur when an employee is sick. Federal employees enjoy a host of leave-related entitlements, including a large swath of leave tied to family member medical conditions, including sick leave and FMLA. With FMLA, the employee may substitute paid leave, and now with the Federal Employee Paid Leave Act, employees have another type of leave to cover birth and placement. It can all seem quite confusing, but FELTG is here to help.

In this two-part virtual training program, FELTG Senior Instructor Barbara Haga will provide you with the tools and knowledge to answer the toughest questions on all of these entitlements, and she’ll explain how they overlap. The Family & Medical Leave Act adds an additional layer of complexity to illness-related absences. Though it’s more than 25 years old, the FMLA still causes significant confusion for agency professionals. To complicate matters, the Federal Employee Paid Leave Act adds a new layer of regulations and a new type of leave to be substituted. Barbara Haga knows the FMLA inside out, and she will share her knowledge with you from basic requirements to FMLA-related discipline, such as excessive absence, falsified information, and failure to comply with notice requirements. And she’ll discuss the impact of the Federal Employee Paid Leave Act.

In 2020, the Supreme Court ruled that an individual’s sexual orientation or transgender status is covered under Title VII’s prohibition against sex discrimination. And Biden’s Executive Order makes it clear that enforcing workplace discrimination protections based on sexual orientation and gender identity is a priority.

As rioters stormed the Capitol on January 6, it was the heroic actions of an under-staffed Capitol Police team that likely saved numerous lives, including those of many Members of Congress and their staff. Unfortunately, the lives of two Capitol officers have been lost.

The Federal workforce is full of talented and brave law enforcement personnel across many agencies. Yet, just as there is a small minority of misbehaving and toxic Federal workers, the same applies to Federal LEOs. In fact, a number of Federal LEOs have been suspended and others are being investigated as a result of their actions during the riot. And after reports of police officers being identified among the rioters, the promises to be deeper investigations into the infiltration of Federal and non-Federal officers affiliated with hate and white supremacy groups.

This creates a lot of questions regarding LEO conduct:

  • How do conduct standards for LEOs differ from other employees?
  • Are conduct standards for IG employees the same as other LEOs?
  • What kinds of conduct could cause an LEO to have a security clearance revoked?
  • When should an agency consider an indefinite suspensions and invoking the crime provision?
  • What proof does the agency need to provide if the employee appeals her removal?

Attorney and FELTG Instructor Ann Boehm will highlight the Douglas factors that are of specific importance when disciplining officers, explain the MSPB’s role when a security clearance is revoked, discuss Giglio  issues, and identify the pitfalls that agencies need to avoid when disciplining Federal LEOs.
