Reasonable Accommodation: Meeting Post-pandemic Challenges in Your Agency

The pandemic is officially over, yet it continues to pose a significant challenge to Federal agencies, particularly in the area of reasonable accommodation.  COVID continues to keep many people from returning to the physical workplace. And the long-term impacts of COVID are now being felt.

Join FELTG Instructor and Attorney at Law Katherine Atkinson for this two-hour class to ensure you are prepared for this new world of reasonable accommodation.

Employee needs, physical conditions, and medication adjustments evolve over extended periods. Once successful accommodations may no longer be effective. You must have a process in place to properly re-evaluate the effectiveness of employees’ accommodations.Get ready, you’re going to hear a lot about the word “telework” in these accommodation discussions. After all, employees successfully worked remotely for almost two years, so why wouldn’t it be a viable and effective accommodation? Virtual Training Event – Effectively Managing and Communicating With Employees

Course Description

To paraphrase Peter Drucker’s quote about leadership, “Communication is how we get things done through others.” No matter the mode, our word choice, tone, gestures, images, and timing convey information. Effective communication has the power to persuade, inspire, educate, and praise. When communication goes off track, it can alienate, insult, anger, and frighten. Relationships with our Federal employees can either be enhanced or damaged by the way we communicate.

In this class, FELTG Instructor Susan Schneider will share communication skills from her experiences in Federal agencies, combined with findings from recent research and a study of best practices. She’ll address communicating in teams or one-on-one, face-to-face or virtual, audio or written, and how strategies apply to management interactions. Realistic scenarios will emphasize the importance of truly listening and seeking to understand discussions and exchanges in the Federal workplace.

Virtual Training Event – Nondiscriminatory Hiring in the Federal Workplace: Advancing Diversity, Equity, Inclusion and Accessibility

The federal hiring process is a challenging one that requires patience. Those who hurry the hiring process are not only likely to make a mistake in hiring, but they may also end up without sufficient documentation to combat a discrimination complaint, making the allegation difficult to defend against.

And there is NO excuse these days for having any steps in your hiring process that could be discriminatory. Per Executive Order, your agency should have already taken steps to “advance diversity, equity, inclusion, and accessibility,” and “eliminate, where applicable, barriers to equity, in Federal workforce functions.”

Regardless of where you are in the development of an agency Diversity, Equity, Inclusion, and Accessibility (DEIA) plan or whether your agency is even currently hiring, this half-day virtual training provides important guidance that you cannot afford to miss if you want to ensure your hiring practices are nondiscriminatory and align with the federal merit system principles.

FELTG instructor and attorney at law Katherine Atkinson will explain the types of interview questions that cause problems, and discuss selection panel roles and responsibilities, including ensuring the selecting officials implement best practices to develop and maintain evidence, demonstrating the non-selection was neither discriminatory nor retaliatory.

In this half-day training, FELTG Instructor and Attorney at Law Katherine Atkinson will provide the foundation you need to jumpstart your DEIA efforts or take them to the next level. After an overview of civil rights law, Ms. Atkinson will share everything you need to know to foster DEIA at your agency, including:

  • What the EO says about agency obligations to underserved communities

Virtual Training Event – Get it Right the First Time: Accepting, Dismissing and Framing EEO Claims

It could be a timeliness issue, failure to state a claim, or something else. Sometimes your agency has a responsibility to dismiss an EEO complaint. However, you do so at your own risk. A surprisingly large number of agency dismissals are overturned by the EEOC each year – and a remand years after the events in question can equal big problems when it comes to the investigation.

How do you balance the obligation to dismiss faulty complaints without unlawfully stripping someone of their rights to the EEO process and ending up on the wrong side of an EEOC decision in the process?

Join FELTG Instructor Katherine Atkinson for this two-day look into the core of the complaint process — determining whether to accept or dismiss an EEO claim. Ms. Atkinson will review the lawful reasons for dismissing a claim and how to make that determination. She’ll also take you through the process of spotting and framing claims based on each of the theories of discrimination.

Virtual Training Event – Clean Records, Last Rites, Last Chances, and Other Discipline Alternatives

If you’ve attended FELTG accountability training, you know the numerous pitfalls that can derail an agency’s disciplinary action, whether it’s suspension, demotion, or removal. But even when executed correctly, traditional discipline can sometimes make a bad situation worse. For example: You suspend an employee and create more work for everyone else on the team. Sometimes, the most “effective and efficient” approach is not a traditional disciplinary action. Late last year, OPM issued regulations that removed a prohibition on clean record agreements, returning to agencies a tool “to resolve informal and formal complaints.” It is one of many alternative disciplinary tools Federal supervisors have. In this two-hour virtual training, FELTG Instructor Ann Boehm  will explain why, how, and when to use numerous alternative actions, including not just clean record agreements, but also:

  • Last chance agreements
  • Last rites agreements
  • Paper suspensions
  • Reprimands in lieu of suspensions
  • And more

The goal of discipline is to rehabilitate. In certain circumstances, alternative sanctions are the more effective approach. You’ll leave this session knowing how to identify the right disciplinary alternative for your situation and the appropriate steps to see it all the way through successfully. Discovery is a critical and effective part of any litigation – when conducted properly. Annoying and abusive discovery techniques could have negative consequences, and possibly even lead to sanctions. From disrespect and profanity in depositions to the other party refusing to produce requested documents, it’s important to be prepared for any situation. In this half-day class, Attorney at Law Katherine Atkinson will provide you with a grounding in the Federal Rules of Evidence, as well as the procedural methods for the MSPB and EEOC. Ms. Atkinson will offer guidance on all forms of written discovery – interrogatories, document requests, depositions, and requests for admission – and she’ll review possible sanctions and how best to avoid them.

Webinar – Feds Gone AWOL: What to Do When Employees Don’t Show Up

Your agency has ordered some employees to return to the physical workplace, and one of them hasn’t shown up for work for three days straight. He hasn’t contacted his supervisor either. Is the best way to discipline the employee to charge him with AWOL?  What if he comes up with a reasonable explanation for his absence?  Can you deny a leave request when an employee was AWOL?

When it comes to AWOL, there are a lot of questions. And a lot of misunderstandings. For example: Considering the following statements:

  • You can’t discipline an employee for AWOL unless it has reached a certain number of days.
  • Employees can’t be removed for AWOL.
  • You can’t be charged AWOL for time that you were physically present in the office.

None of these statements are true; they are AWOL myths.

In this 60-minute presentation, FELTG President Deborah J. Hopkins will deconstruct the mystery of Absence Without Leave (and its companion charge, Unauthorized Absence), shatter the aforementioned myths, and offer strategies for agencies to take when an employee doesn’t show up for work.

Virtual Training Event – Drawing the Line: Union Representation or Misconduct

Robust. Uninhibited. Wide-open. These are words the U.S. Supreme Court used to describe the type of debate by union officials that is considered “protected activity.” But how robust, uninhibited or wide open? And when? Those are the questions that Ann Boehm will answer during this training.

There are many tales of profanity, shouting, rough speech, and bullying taking place between union reps when performing representational duties — and not just during negotiations. Ms. Boehm will share several cases that highlight robust activity that were considered “protected activity” and provide details of FLRA decisions that illustrate behavior that very clearly crossed the line into misconduct.

Virtual Training Event – Workplace Investigations Week

Course Description

This week of FELTG training focuses on conducting administrative investigations in the federal workplace with an emphasis on employee misconduct, including workplace harassment. After an overview of the substantive law, participants will learn procedures and best practices for conducting administrative investigations, including understanding what constitutes misconduct, the differences between EEO and non-EEO harassment, planning the investigation, fact finding, collecting evidence, dealing with witnesses, understanding types of questioning, and testifying at hearing. The week concludes with a day focused on writing an investigative report.

Special content will also discuss conducting investigations post-pandemic, including tips for interviewing witnesses virtually, addressing safety concerns during in-person interviewing and evidence gathering, and more.

Note: This class includes breakout discussions and workshops, and attendees are encouraged to participate via audio. Because of the interactive nature of this program attendance is limited, so register early to guarantee your spot.

Webinar – Red Light, Green Light: Revisiting Existing Reasonable Accommodations

Course Description

Congratulations, you’ve gone through the interactive process and come up with a reasonable accommodation that both you and the employee think will be effective.

But wait. It’s not over yet.

Over time, accommodations may lose their effectiveness. They may no longer be needed. The nature of the work might change. Or, perhaps, a more effective accommodation has become available. One of the most important, yet often forgotten, parts of the reasonable accommodation process is the follow up, or what FELTG calls the “check-in.” It’s more important than ever for agencies to be aware of the benefits and pitfalls of revisiting existing accommodations.

And as employees have begun returning to the physical workplace at least a few days a month, now may be the time to re-evaluate the effectiveness of employees’ reasonable accommodations.
