Webinar – Understanding Religious Accommodation: How it’s Different from Disability Accommodation

Instructor

Meghan Droste

Course Description

 1.5

Almost everyone knows that individuals with disabilities are entitled to reasonable accommodation – but did you know that federal employees are also entitled to reasonable accommodation for religious beliefs and practices? Not everyone realizes this; in 2017 a company in West Virginia was ordered to pay out damages of nearly $600,000 for not taking an employee’s religious accommodation request seriously.

The law requiring religious accommodation is different than the law for disability accommodation, and it’s important you know the distinctions. Join FELTG for the final session in the Four-Part Reasonable Accommodation in the Federal Workplace webinar series, where Attorney at Law Meghan Droste helps in your goal of Understanding Religious Accommodation: How it’s Different from Disability Accommodation.

After a review of the relevant law and regulations law that pertain to religious accommodation, Ms Droste will discuss:

  • What religions qualify for accommodation
  • The definition of “undue hardship” and case examples
  • The most common accommodations for religion
  • Issues related to dress code and grooming
  • What to do when employees request to be excused from performing certain job tasks because of religious reasons

Whether you’re an attorney, EEO program specialist, HR specialist or manager, you’ll want to be sure to join us for this important session.

Course Description

It’s that time of year again! And boy, do we have some new material, with the new executive orders on accountability and labor relations, plus several much-anticipated FLRA decisions bringing clarity to questions we’ve had for years.

Twice a year we update you with what’s new from the MSPB, EEOC and FLRA, and this one looks to be better than ever.

Join FELTG attorneys William Wiley and Deborah Hopkins as they combine forces for a fast-paced discussion on the most surprising, significant and groundbreaking recent decisions and trends from the MSPB, EEOC and FLRA. If you’ve attended a past edition, you know this is not your standard [“boring”] case law update, but an editorial discussion that not only informs you about current cases, but explains how they impact your daily work whether you’re a lawyer, or an HR, ER, LR or EEO practitioner.

Bill and Deb will share where we’ve been and where we’re headed with the trends and regulations that influence your workplace and the way issues are litigated in your agency or union. Plus, ask your questions and get answers in real time.

We’d love to tell you now about the cases and regulations that will be discussed, but that’s entirely up to the MSPB, EEOC and FLRA. Stay tuned!

Barbara Haga

Course Description

Absence due to illness has changed the landscape in dealing with federal workplace issues.  Problems arise when employees are absent – let alone the huge amounts of leave entitlements tied to family member medical conditions.

Administering sick leave can be complicated, and proper documentation is critical.  The Family & Medical Leave Act adds an additional layer of complexity to these illness-related absences.  When can you require medical examinations? When can you take action on excessive absences?

If you need more information on absence related to illness so you are able to answer those tough questions on sick leave and FMLA – or if you want to ensure that the adverse action case you assemble will withstand the scrutiny of the MSPB – then this webinar series is custom-made for you.

While the near future of the Merit Systems Protection Board remains uncertain, Ms. Haga is  staying on top of the situation and will provide attendees with the most up-to-date information they need to know.

Join instructor Barbara Haga for any or all of the sessions as she guides you through these thorny issues.

  • Session 1 – Sick Leave, Part I (1/23)

Developing & Defending Discipline: Holding Federal Employees Accountable – Oklahoma City @ Hilton Garden Inn Bricktown
Feb 26 – Feb 28 all-day

Download Registration Form

Holding federal employees accountable for performance and conduct is easier than you might think. Too many supervisors believe that an employee’s protected activity (EEO complaints, whistleblower disclosures, or union activity) precludes the supervisor from initiating a suspension or removal, but that’s just not true.

FELTG is here to make federal supervisors’ lives easier by clarifying those misconceptions while helping supervisors understand how to take defensible misconduct actions quickly and fairly – actions that withstand scrutiny on appeal by the MSPB, EEOC, or in grievance arbitration. Plus, if you have a non-performing employee working for you now, we show you how you can remove that employee from your workplace in 31 days, among many other things. Join us for this brand-new three-day seminar and come away with the tools you need to hold your employees accountable.

The program runs 8:30 – 4:00 each day and meets OPM’s mandatory training requirements for federal supervisors found at 5 CFR 412.202(b).

Instructors

Deborah Hopkins, Dwight Lewis

Daily Agenda:

Tuesday

Accountability for Conduct and Performance, Part I: Accountability and supervisory authority; discipline and misconduct theory and practice; penalty defense and due process; discipline procedures and appeals; psychology of performance appraisal; performance-based removal procedures.

Wednesday

Accountability for Conduct and Performance, Part II: Completing a performance action; team workshop; mentoring programs; handling the absent employee; understanding the federal supervisor’s personal liability in employment actions.

Thursday

Defending Against Discrimination Complaints: The Supervisor’s Role: The role of EEO in the federal government; defining protected categories: race, color, national origin, religion, sex, age, disability, genetic information and reprisal; theories of discrimination; agency defenses; what to do if you’re a Responding Management Official in a complaint; what happens if you’re called as an EEO witness.

Course Description

Reprisal is a term that gets used a lot, but did you know that it has different definitions in different cases? If you join FELTG President Deborah Hopkins during this 90-minute webinar to find out exactly where the differences lie, you just might save your agency from losing a reprisal case.

During this interactive discussion, Ms. Hopkins will explain the legal background on the various forms of reprisal and why it’s such an important area of focus in federal employee statutory protection. From there, she will talk about:

  • Whistleblower reprisal: the standards, burden of proof, and actions that constitute reprisal
  • The many forms of EEO reprisal and why it’s the most common category in discrimination findings
  • Reprisal for union activity, including what type of activity falls outside the bounds of coverage
  • What is legal and not legal when considering someone’s veteran status in making employment-related decisions
  • The distinction between reprisal and retaliation

This is an event you won’t want to miss, whether you’re an attorney, LER specialist, EEO specialist, union official or supervisor. We hope you’ll join us.

Course Description

In 2017, an MSPB survey revealed that more than 20 percent of female federal employees were sexually harassed in the workplace between 2014 and 2016. There has been a lot of talk about the need for training on this important topic. But now it’s time for action.

Let FELTG help you take that action. Join us for the 90-minute webinar Employee Sexual Misconduct: Discipline Early to Make Your Agency a Safer Place. FELTG President Deborah Hopkins, attorney at law, will show you how to address sexual harassment in the federal government as MISCONDUCT — not just as an EEO issue.

We’ll discuss the foundational law and how sexual harassment cases come to be, but our emphasis will be on STOPPING it from happening by addressing the misconduct before it becomes a problem. Case examples will show you the best ways to handle inappropriate sexual conduct from employees and supervisors – and things to avoid. We hope you’ll be able to attend this important discussion.

Standard Tuition: $305 per site (for payments made June 18 or later)

Instructor

Ann Boehm

Course Description

The Douglas factors require agencies to consider alternative sanctions, but what exactly are alternatives to discipline? How do they work? Does anyone even know where to start an alternative to discipline?

FELTG instructor Ann Boehm does. In this 90-minute webinar, she will show you how how to think outside the box in certain disciplinary situations. For example, the last thing you want to do to someone who is AWOL is suspend them — they already are not coming to work. Instead, we can show you how to give a reprimand in lieu of suspension. The goal of discipline is to rehabilitate, and in certain circumstances, alternative sanctions are very effective in that regard.

Attendees will:

  • Learn the legal requirements that form the foundation of disciplinary actions.
  • Identify several alternatives to adverse actions.
  • Understand the benefits of a reprimand in lieu of a suspension.

Webinar – Changing Course: Understanding the Biden Executive Orders on Racial Equity, Gender Identity, and Sexual Orientation
Feb 9 @ 1:00 pm – 2:00 pm

Download Registration Form

Course Description

On his first day in office, President Joseph R. Biden made it clear that Federal employees are a priority: He took action to advance racial equity throughout the federal government and strengthen workplace discrimination protections based on sexual orientation and gender identity. A focus of this Administration early on has been to celebrate the diversity of the Federal workforce and to make it an inclusive place for all employees.

Now, it’s up to you.  Executive Orders 13985 and 13988 denote a sense of urgency, and include agency requirements with timelines to perform necessary compliance actions, some as soon as 60 days – and the clock started ticking on January 20.

In this 60-minute webinar, FELTG President and attorney at law Deborah Hopkins will give a thorough explanation of the two first-day executive orders that call upon agencies to review current policies and procedures, and develop plans to “address unequal barriers to opportunity in agency policies and programs.” This webinar will focus on the following Executive Orders, and will also discuss other applicable actions taken by President Biden:

  • Advancing Racial Equity and Support for Underserved Communities Through the Federal Government
  • Preventing and Combating Discrimination on the Basis of Gender Identity or Sexual Orientation

So where do you start? What do the Executive Orders specifically prescribe? And what’s necessary to meet those requirements? Join us on February 9 to get those answers.

Like all FELTG training events, this webinar will be updated to the minute. You can’t afford to miss it.

Webinar – Changing Course: Understanding the Biden Executive Order on Labor Relations, Performance, Discipline, and Schedule F
Feb 25 @ 2:30 pm – 4:00 pm

Download Registration Form

Course Description

When President Biden signed Executive Order 14003, Protecting the Federal Workforce, he revoked President Trump’s Executive Orders 13836, 13837, and 13839 and eradicated the Schedule F classification mandated by Executive Order 13957. It’s been decades since the civil service has seen so much change in just one stroke of a pen.

This far-reaching Executive Order has significant impact on labor relations official time, contract negotiation timelines, topics of bargaining, performance and disciplinary actions for non-union employees, clean record settlements, and more.

You might have questions, such as:

  • What does this mean if your CBAs were already renegotiated?
  • Is progressive discipline going to be mandatory now?
  • Do Performance Demonstration Periods have to be longer than 30 days? Can we call them PIPs again?
  • What happens if your agency already sent Schedule F lists to OPM?
  • What will become of the OPM regulations implementing EO 13839
  • What changes if permissive bargaining is now mandatory?

In this 90-minute webinar presented by FELTG President Deborah Hopkins and FELTG Instructor Ann Boehm, you will get answers to those questions and much more. EO 14003 prescribes several specific actions that agencies must take. So where do you start? Join us on February 9 to get those answers.

Like all FELTG training events, this webinar will be updated to the minute. You can’t afford to miss it.

Webinar – Biden Executive Orders, OPM Guidance, and an Update on the Status of Civil Service
Apr 8 @ 1:00 pm – 2:30 pm

Download Registration Form

Course Description

The Executive Orders President Biden signed early on in his presidency have significantly changed the face of the federal workplace, leading to changes in workplace diversity initiatives, LGBTQ issues, labor relations official time, union contract negotiation timelines, topics of bargaining, performance and disciplinary actions for non-union employees, clean record settlements, and much more.

If you attended one of FELTG’s recent webinars on the Biden Executive Orders, then you know some of this already. But that’s not enough. OPM guidance has been provided, and that guidance could dramatically change many processes and procedures for Executive Orders 13985, 13988, and 14003. Join FELTG for this new and updated-to-the-minute comprehensive training event where President Deborah Hopkins and Instructor Ann Boehm will dive into the language of the EOs, related OPM guidance, and significant legal decisions, and interpret what it means to your day-to-day operations.

The federal workplace remains in a state of flux. The administration has nominated Kiran Ahuja to lead the Office for Personnel Management and made changes in the leadership of the EEOC and FLRA. Can nominees to the MSPB be far behind? Meanwhile, the majority of federal employees continue to work remotely, yet agencies plan for the return of vaccinated employees. Ms. Hopkins and Ms. Boehm will provide you with all of the latest information on federal employment law-related news and thoroughly explain their impact.

If you missed any of the recent FELTG webinars on the Biden Executive Orders, then hurry up and register. You have a lot to catch up on. If you already attended, this session will build on the last one with newer, updated guidance. In this 90-minute webinar, you will get the answers to all of your questions, such as:

  • Does OPM guidance address what to do if your CBAs were already renegotiated?
  • How have workplace protections changed for transgender employees?
  • How long are Performance Demonstration Periods supposed to be?
  • What has become of the OPM regulations implementing EO 13839?
  • Is progressive discipline mandatory now?
  • What changes if permissive bargaining is now mandatory?
  • Are there any restrictions on diversity training?

And you’ll have the opportunity to ask your own questions, and get answers, in real time.

The federal workplace is undergoing a dramatic shift right now, and you can’t afford to miss this training event.

Aug 18 @ 1:00 pm – 2:00 pm

Instructor

Bob Woods

Course Description

When the vaccine mandate, which is now on hold for many agencies, was first being enforced, vaccine-hesitant employees filed reasonable accommodation requests to be exempt from the vaccine for religious reasons. It’s probably the most religious accommodation requests agencies have received in years.

Yet, unfortunately, there is still much confusion about the law. It’s different than the law for disability accommodation, and it’s important you know the distinctions. Join FELTG for the final session in the five-part Reasonable Accommodation in the Federal Workplace webinar series.

After a review of the relevant law and regulations law that pertain to religious accommodation, FELTG Instructor Bob Woods will discuss:

  • What religions qualify for accommodation
  • The definition of “undue hardship” and case examples
  • The most common accommodations for religion
  • Issues related to dress code and grooming
  • What to do when employees request to be excused from performing certain job tasks because of religious reasons

Whether you’re an attorney, EEO program specialist, HR specialist or manager, you’ll want to be sure to join us for this important session.

Price

  • Early Bird Tuition: $250 per site, per session (payment made by July 11).
  • Standard Tuition: $280 per site, per session (payment made July 12 or later).
  • Register for all five webinars in the series by July 11 and pay only $1195!

Almost everyone knows that individuals with disabilities are entitled to reasonable accommodation – but did you know that federal employees are also entitled to reasonable accommodation for religious beliefs and practices? And that the law is different? And that the Supreme Court has recently weighed in on this subject?

It’s important you know the distinctions and understand the legal ramifications. Join FELTG for the final session in our five-part Reasonable Accommodation in the Federal Workplace in 2023 webinar series.
