Accountability for Conduct: Taking Defensible Disciplinary Actions

Course Description: This session begins with a discussion on the foundation of supervisory authority, and it will clarify the too-common misconceptions that prevent federal agencies from taking successful misconduct actions against employees. Attendees will learn the five elements that must be present in a disciplinary case, with a special focus on penalty justification and due process requirements. Attendees will leave with the guidance necessary to take defensible actions quickly and fairly – and to ensure that those actions will withstand scrutiny on appeal by the MSPB, EEOC, or in grievance arbitration. Unacceptable Performance: Streamlining the Procedures
Presented by William Wiley, Attorney at Law, FELTG Past President

Course Description: When it comes to poor performance, the one action you can’t afford to take is not taking action. Yet, when you do take a performance-based action, there are limitless mistakes that can trip you up and result in lost appeals. During this session, Bill Wiley shares the tools you need to confidently and effectively address poor performance, including initiating a performance demonstration period/PIP, the evidence and documentation needed to justify a performance-based action, and a secret trick on removing an employee for poor performance without using a demonstration period/PIP. After this session, attendees will have the tools necessary to remove an unacceptable performer in 31 days. Earn 1.5 CLE credits.

Course Description: In the world of federal employment law, things can change quickly; there has been more action in the past three years than in the last 35 years before. Join FELTG Instructor Ann Boehm for a review of the most recent and relevant cases, regulations, studies and reports from the EEOC, FLRA and MSPB, plus information from OPM and the Office of Special Counsel. She will also cover the very latest on Executive Orders 13836, 13836, 13837 and 13839. Preventing and Correcting Discrimination: A Focus on Race, Color, and National Origin

In some cases, employees perceive a conflict with agency management to be motivated by an illegal reason. And every now and then, an agency official engages in unlawful discrimination, and then the agency has a responsibility to make amends with the employee. Course description: Reasonable accommodation for disabilities intersects with every aspect of the federal workforce: conduct, performance, leave, telework, and more. FELTG Instructor Meghan Droste will explain answers to the most common questions including: What does qualified individual really mean? What is the agency required to do during the interactive process? Must I provide a provisional accommodation? Do I have to grant telework as an accommodation? Is providing a new supervisor a reasonable accommodation? You’ll receive guidance on other perplexing reasonable accommodation challenges, and discuss the mistakes agencies have made in recent cases – so you can avoid similar mistakes. Almost 18 percent of all adults have a mental illness diagnosis at some point in their lives. The COVID-19 pandemic has exacerbated the ongoing mental health crisis in this country. Meanwhile, much of the federal workplace is struggling with new work processes and heightened responsibilities, especially those working directly on the pandemic while navigating political minefields.

This virtual training program will provide highly practical guidance and straight-forward advice on dealing with the very unique challenges you face at this time. Licensed Clinical Social Work Shana Palmieri will de-stigmatize the truth about “mental illness” and will explain the impact various mental health conditions have on individuals, and those they work with. Course Description

From chronic pain and chronic fatigue to depression and diabetes, employees may be suffering from physical or mental impairments that aren’t obvious. Meanwhile, far too many federal employees and supervisors have a perception that if a disability isn’t visible, then it must not be “real.” And then there’s the fact that most employees are working remotely during pandemic, making the accommodation process even more challenging for HR professionals, supervisors, and the people who advise them.

Successful reasonable accommodation requires a two-pronged approach:

  1. An understanding of how to properly navigate the legal requirements, and
  2. Practical strategies to determine the most effective accommodation based upon knowledge of the actual impairments.

FELTG President and attorney at law Deborah Hopkins will kick off this virtual training with a thorough review of the ADA and Rehab Act requirements, plus EEOC guidance on accommodating individuals with mental impairments, behavioral health issues, and other hidden disabilities. Then Licensed Clinical Social Worker Shana Palmieri will discuss the best approaches to take – and those to stay away from – as you work with employees to accommodate their unseen disabilities.

The country and its workplaces are eyeing a return to pre-pandemic normalcy. But normal didn’t equate to perfect before COVID-19, and it won’t be that way after. As virus-related restrictions began to ease in recent weeks, news networks shifted their focus to a string of deadly violence across the country. The network attention was new, but the violence wasn’t. It had been on the upswing before the pandemic even arrived.

It’s not hyperbole to suggest that a violent threat (whether by gun, knife, vehicle, bomb, or mob) in or near your workplace would be the most demanding and traumatic situation you’ve ever faced.  Unfortunately, the federal government is not immune from this violence, as recent events at the Capitol illustrate. This training aims to provide you with the knowledge and foresight to be as prepared as you can be.

The COVID-19 pandemic has exacerbated the ongoing behavioral and mental health crisis in this country. Almost 18 percent of all adults have a behavioral health diagnosis at some point in their lives. After a year of isolation, new work processes, heightened responsibilities, and political minefields, employees with a mental health diagnosis will soon be returning to the physical workplace.

On April 30, OPM released a memo on the importance of mental health and the well-being of Federal employees: “Awareness of mental health supports for Federal employees is an important element of protecting employee well-being and sustaining a high performing Federal workforce.”

Nearly 8 million adults annually experienced Post-Traumatic Stress Syndrome in a given year – and that data was collected before the pandemic. More recent studies show increases in stress, anxiety, and PTSD among adults, and at the same time agencies are planning to bring employees back to the physical workspace. Attendees will learn how PTSD, stress, and anxiety could manifest in the workplace and how agencies can create success for employees with these mental health conditions.

The rates of anxiety and depression among U.S. adults increased times 4 between April 2020 and August 2021, compared to 2019. Prior to the pandemic anxiety rates hovered between 7.4% – 8.6% of U.S. adults, compared to 28.2% and 37.2% after the pandemic hit.  Similarly, for depressive symptoms prior to the pandemic, the rates hovered between 5.9% -7.5% compared to 20.2% to 31.1% after the pandemic.

Assessing Risk and Taking Action: Threats and Violence in the Federal Workplace

We were all still processing the news of the horrific gun violence at a dance studio in Monterey Park, Calif., that killed 11 people, when news broke of another mass shooting in the Golden State. Authorities have deemed the shooting in Half Moon Bay that killed seven as “workplace violence” that stemmed from “workplace conflict.”

Whether it’s a disgruntled employee or customer, or a domestic issue that follows an employee to work, workplaces are at a distinct risk of violent incidents.

How you prepare yourself to protect the lives of those around you? Are there risk factors that might give you an indication of when someone will become violent? What can you do to help prevent a violent tragedy occurring where you work?

Want to reduce conflict, increase productivity, and limit absenteeism, turnover, and even removals? That’s impossible, you say. Maybe not, if you learn how to effectively manage individuals whose behavior repeatedly generates workplace conflict.

Attend this two-hour presentation and learn how to recognize employees with high-conflict personalities, whether it’s individuals who blame their peers for mistakes, tend to think in all or nothing terms, or display intense emotions. But spotting the issue isn’t the only problem. FELTG Instructor Shana Palmieri, LCSW, will also share how to effectively manage these challenging individuals.

Attendees will learn how to:

  • Recognize the four traits of a high-conflict personality.
  • Intervene successfully in situations involving high-conflict personalities.
  • Identify strategies in the workplace to reduce overall conflict.

    • FELTG uses Zoom to broadcast this Virtual Training Institute event. Many government computers and systems allow Zoom access. If for some reason your firewall will not allow access, you’re welcome to use your personal email address to register, and to attend the sessions from your personal device.
  • Can I share my access link with co-workers?
    • No. Registration for this event is per individual, and access links may not be shared. Each link may only be used by one person.
  • Can I register a teleworker?
    • This event is individual registration, so the cost is the same whether the person is teleworking or in an agency facility.
  • How do I receive a group rate discount?
    • Group rates are available for agencies registering 10 or more individuals. Group discounts are available through February 27.
