March 7: Why Supervisors Need to Use the Douglas Factors

If you’re not using the Douglas factor analysis to figure out an appropriate penalty for a misbehaving employee, then you’re doing it wrong. And when an appeal is filed, your action may not be so easy to defend without this justification. A scan of MSPB cases reveals how regularly Federal supervisors fail to understand these factors, and how that lack of understanding may sink the agency’s case. FELTG instructor Ann Boehm will explain the importance of the Douglas factors, using both foundational and recent case law examples, and walk you through the importance of each factor.

 April 4: 5 Keys to Implementing and Managing a Successful Performance Opportunity Period

You’re not alone. Every agency has employees whose performance is unacceptable. The key to addressing poor performance is to initiate an opportunity to demonstrate acceptable performance (called everything from a PIP or OIP to an ODAP or DP). A successful opportunity period will either lead to sustained improved performance OR a defensible performance-based removal. From the Santos requirement to a post-PIP drop in performance, FELTG President Deborah Hopkins will explain the key steps to take and pitfalls to avoid.

May 2: They Just Won’t Show Up: Handling Excessive Absence

In a year when no-shows are more common than they should be, supervisors need to understand how to handle excessive absence, using the appropriate tools to correct employee behavior, while keeping in mind cases that involve reasonable accommodation or medical inability to perform. In 60 minutes, FELTG Senior Instructor Barbara Haga will share the documentation needed and steps necessary to effectively discipline an employee for excessive absence, leave abuse, and other related matters.

June 6: Ensuring Accountability with Hybrid and Teleworking Employees

Many experts agree: The performance success of a hybrid or telework environment will come down to managers and supervisors. You may think you know how to discipline. The effects of the pandemic live on in an increase in chronic fatigue and depression, not to mention the severe impact of long haul COVID. Meanwhile, chronic pain, diabetes, and other non-visible disabilities are on the rise as the Federal workplace continues to age. During this webinar, managers will learn how to find the right accommodation for a number of hidden disabilities.

August 22: What Supervisors Should Know About Official Time

The Labor-Management Statute holds labor and management equally accountable to the taxpayer with a shared responsibility to ensure that official time is authorized and used appropriately. In this 60-minute class, Joseph Schimansky will share everything that supervisors need to know to uphold that responsibility without overstepping their role. Attendees will learn who is entitled to official time — and who isn’t, along with the latest relevant case law and guidance.

Virtual Training Event – Advanced EEO: Navigating Complex Issues

Course Description

A supervisor sees his employee going into an investigation interview and says, “Just don’t play the race card.” An employee, who was provided new software as a reasonable accommodation, tells you weeks later that her computer has “been glitchy” since the new software was added.

When EEO challenges arise, they rarely show up as run-of-the-mill simple scenarios you’ve worked through in a training class. Are you an EEO professional, attorney or advisor eager to learn how to more effectively manage the unexpected EEO issues? Are you looking for guidance to answer challenging questions, such as: Can an agency be held liable for retaliation in a disciplinary action if the deciding official was unaware of the employee’s prior protected activity? The reasonable accommodation process starts with a request from an employee or applicant. However, that request does not need to be in writing or be formalized in any certain way. In fact, an agency cannot require that a request for reasonable accommodation even include the words “ADA,” “request,” or even “reasonable accommodation.”

Heck, the request doesn’t even have to come from the employee.

If a employee makes a reference to a need for an adjustment or change and it’s related to a medical condition, then you have a request for reasonable accommodation.

During this training, you’ll receive guidance on how to “spot” a reasonable accommodation request, discuss the importance of having a reasonable accommodation policy, and provide examples of each.

Webinar – How Do I Know if an Accommodation is an Undue Hardship?

Agencies must accommodate qualified individuals with disabilities unless doing so would be an undue hardship. But what constitutes “undue hardship?” It’s a term of art that’s not so easily defined. And since it’s the only “statutory limitation on an employer’s obligation to provide reasonable accommodation,” the undue hardship claim is one that’s often misunderstood and misused.

This presentation will provide a thorough review of the various factors involved in making an undue hardship determination, as well as a review of case examples that show when the determination was made correctly and, more importantly, when it wasn’t.

The Post-pandemic Federal Workplace: Telework and Hybrid Work Challenges

The pandemic has likely forever changed the Federal workplace. More employees (and applicants) than ever before not only want to work remotely but expect to. In an effort to bring some employees back to their physical workspace, the “hybrid” workplace has become the norm for most Federal agencies.

With some people working remotely and others onsite, how do you ensure that you hold all employees accountable for performance – and how do you ensure that it’s done fairly? And how do you handle the increasing number of requests to telework, especially those citing the request as an accommodation for a disability?

Some employees will struggle regardless of whether they’re at home or in an office. Using framework from FELTG’s flagship course UnCivil Servant: Holding Employees Accountable for Performance and Conduct, Ann Boehm will provide guidance on swiftly and effectively addressing unacceptable performance, regardless of where the employee is working. Plus she’ll discuss setting expectations and monitoring performance of employees who aren’t onsite.

Charges and Penalties Under the New MSPB

If you’ve been in the business for more than a few days, you know the importance of drafting legally sufficient disciplinary charges and making a defensible penalty determination. Yet many agencies still lose cases because of poorly drafted charges, or inadequate Douglas factor penalty assessments.

FELTG President Deborah J. Hopkins will cover the art and science behind drafting disciplinary charges, including the types of charges, parts of a charge, how charges are interpreted, and alternative charges. From there the discussion will cover the factors required to determine an appropriate penalty for employee misconduct. We’ll also look at how the current MSPB views charges and penalties by deconstructing recent cases they’ve issued.

Bad Detective: The Mistakes That Hamper Agency Investigations

Some employees will struggle regardless of whether they’re at home or in an office. If you’ve been in the business for more than a few days, you know the importance of drafting legally sufficient disciplinary charges and making a defensible penalty determination. Yet many agencies still lose cases because of poorly drafted charges, or inadequate Douglas factor penalty assessments.

FELTG President Deborah J. Congratulations, you’ve gone through the interactive process and come up with a reasonable accommodation that both you and the employee think will be effective.

But wait. It’s not over yet.

Over time, accommodations may lose their effectiveness. They may no longer be needed. Or, perhaps, a more effective accommodation has become available. One of the most important, yet often forgotten, parts of the reasonable accommodation process is the follow up, or what FELTG calls the “check-in.” It’s more important than ever for agencies to be aware of the benefits and pitfalls of revisiting existing accommodations.

March 7: Why Supervisors Need to Use the Douglas Factors

If you’re not using the Douglas factor analysis to figure out an appropriate penalty for a misbehaving employee, then you’re doing it wrong. And when an appeal is filed, your action may not be so easy to defend without this justification. A scan of MSPB cases reveals how regularly Federal supervisors fail to understand these factors, and how that lack of understanding may sink the agency’s case. FELTG instructor Ann Boehm will explain the importance of the Douglas factors, using both foundational and recent case law examples, and walk you through the importance of each factor.

 April 4: 5 Keys to Implementing and Managing a Successful Performance Opportunity Period

You’re not alone. Every agency has employees whose performance is unacceptable. The key to addressing poor performance is to initiate an opportunity to demonstrate acceptable performance (called everything from a PIP or OIP to an ODAP or DP). A successful opportunity period will either lead to sustained improved performance OR a defensible performance-based removal. From the Santos requirement to a post-PIP drop in performance, FELTG President Deborah Hopkins will explain the key steps to take and pitfalls to avoid.

After the success of pandemic-induced remote work, agencies are receiving more reasonable accommodation requests for telework, especially as employees are directed to return to the physical workplace. If someone has successfully teleworked already and is a qualified individual with a disability, must you grant the requested accommodation?

Join us for a discussion on this timely topic during the fourth event in our Reasonable Accommodation in the Federal Workplace in 2023 webinar series. This course will detail the required three-step process for agencies to be compliant when dealing with reasonable accommodation requests.

This week of FELTG training focuses on conducting administrative investigations in the federal workplace with an emphasis on employee misconduct, including workplace harassment. Most disputes in federal agencies settle employment disputes — whether they initiate as grievances, EEO complaints, or as appeals of agency disciplinary actions. While it’s common to assume that settlement means the agency has a flaw in its case, it has no direct tie to liability or admissions of wrongdoing. Often, it’s the most efficient and effective way to handle a dispute and allow you to get back to focusing on your agency’s mission.

Virtual Training Event – All Clear? When Employee Security Clearances are Revoked or Suspended

If a federal employee is required to have access to classified information, then the employee must be eligible for a security clearance in order to keep that position. What happens when that employee no longer has that clearance? What role does the MSPB play? What proof does the agency need to provide if the employee appeals a removal? What are the pitfalls that agencies need to avoid?

During this two-hour virtual event, Ann Boehm will detail how to handle a security clearance revocation and any resulting indefinite suspension or removal from employment. Virtual Training Event – Dealing with Behavioral Health Challenges in the Federal Workplace

Course Description

If one of your agency’s employees had a mental health crisis in the workplace, would you know what to do? And with many employees still working remotely, how would you even know?

Almost 18 percent of all adults have a mental illness diagnosis at some point in their lives. We already had a mental health problem in this country before COVID-19 pandemic, which exacerbated the crisis in this country.

This virtual training program will provide highly practical guidance and straight-forward advice on dealing with the very unique challenges you face at this time. Licensed Clinical Social Work Shana Palmieri will de-stigmatize the truth about “mental illness” and will explain the impact various mental health conditions have on individuals, and those they work with. She’ll provide strategies for effectively supervising and managing employees with these conditions, even as they work remotely. Ms. Palmieri will answer challenging questions, such as:

  • What do you do if you suspect a mental health crisis and the employee won’t answer his phone?
  • How do you provide constructive criticism to someone who exhibits narcissistic behavior?
  • If you suspect that one of your employees has a mental impairment, what can you do beyond directing them to EAP?
  • What are the symptoms of a personality disorder?

Attendees will learn how to walk the tenuous line between providing accommodations and support for a mental health condition and holding employees accountable for their work performance. Attend this timely virtual training event and learn strategies to:

  • Improve performance and success for employees with mental health conditions.
  • Communicate effectively with all employees.
  • Successfully accommodate employees with behavioral health conditions.

Virtual Training Event – Writing Final Agency Decisions

Course Description

Final Agency Decision sounds so, well, “final.” But it most definitely is not. A FAD is appealable, by the complainant, to the EEOC. And many employees have and will continue to take advantage of that opportunity to appeal the agency’s decision. And here’s the thing: The EEOC’s decisions are filled with reversals of the agency’s FAD, finding no discrimination.

How do you avoid such a disappointing decision?

Learn how to write an effective final agency decision. To do that requires a knowing and understanding of discrimination law, as it is uniquely applied to the Federal workplace.

FELTG’s flagship course UnCivil Servant empowers federal supervisors and advisers to confidently handle the challenges that come with supervising in the federal workplace. We hope that you never have to fire an employee. But it’s important that you have the tools to effectively address poor performance and misconduct, should the need arise.

Over the course of two half-days, UnCivil Servant identifies misconceptions about performance and misconduct-based actions and provides you with simple step-by-step guidance for taking swift, appropriate and legally defensible actions. The program also covers the very latest with Executive Order 14003, plus OPM regulations on performance and conduct.

Employee needs, physical conditions, and medication adjustments evolve over extended periods. Once successful accommodations may no longer be effective. Virtual Training Event – Effectively Managing and Communicating With Employees

Course Description

To paraphrase Peter Drucker’s quote about leadership, “Communication is how we get things done through others.” No matter the mode, our word choice, tone, gestures, images, and timing convey information. Effective communication has the power to persuade, inspire, educate, and praise. When communication goes off track, it can alienate, insult, anger, and frighten. Relationships with our Federal employees can either be enhanced or damaged by the way we communicate.

In this class, FELTG Instructor Susan Schneider will share communication skills from her experiences in Federal agencies, combined with findings from recent research and a study of best practices. She’ll address communicating in teams or one-on-one, face-to-face or virtual, audio or written, and how strategies apply to management interactions. Realistic scenarios will emphasize the importance of truly listening and seeking to understand discussions and exchanges in the Federal workplace.
