SUMMARY:The Blunt Truth: Marijuana and Drug Use in the Federal Workplace - June 3\, 2025
DESCRIPTION:Some in the incoming administration\, including the President\, have voiced support for the changing of marijuana from a Schedule I to a Schedule III substance. Meanwhile\, the drug is legal in 38 states for medicinal purposes\, and 24 for recreational purposes. And we continue to receive questions regarding Federal employees and their use\, whether recreationally\, medicinally\, or “accidentally” – of marijuana. \nThis course will review the laws that apply to Federal employees\, plus the latest guidance from the administration. This course fulfills the 5 CFR 412.202(b) mandatory training requirements for new supervisors. \nTuesday\, June 10: Accountability for Conduct and Performance\, Part I \nThe first day begins with a discussion of accountability and supervisory authority and highlights the differences between performance and misconduct issues before launching into discipline theory and practice. We’ll cover the disciplinary framework to apply from minor misconduct to removable offenses\, and discuss how to select the appropriate penalty and ensure the employee with due process along the way. \nWednesday\, June 11: Accountability for Conduct and Performance\, Part II \nAfter a discussion of disciplinary timelines\, documents\, procedures and Merit Systems Protection Board appeals\, the class switches focus to dealing with unacceptable performance and performance-based removal procedures. It includes a discussion about setting clear performance expectations\, clarifying vague performance standards\, implementing a performance Demonstration Period\, and the misunderstood “assistance” element required by law. \nLearning objectives\n\nIdentify the tools supervisors have for addressing misconduct and unacceptable performance.\nName the five elements of discipline and describe how the Douglas factors aid in selecting a defensible penalty.\nProperly implement a performance Demonstration Period (DP)\, often referred to as a PIP.\n\nNote: Participants will receive a copy of UnCivil Servant: Holding Federal Employees Accountable for Performance and Conduct\, 5th edition.
