DESCRIPTION:FELTG’s flagship course UnCivil Servant empowers Federal supervisors and advisers to confidently handle the challenges that come with supervising in the Federal workplace. It shatters misconceptions about performance and misconduct-based actions and gives you simple step-by-step guidance for taking swift\, appropriate\, and legally defensible actions. This course fulfills the 5 CFR 412.202(b) mandatory training requirements for new supervisors. \nWednesday\, February 11: Accountability for Conduct and Performance\, Part I \nThe first day begins with a discussion of accountability and supervisory authority and highlights the differences between performance and misconduct issues before launching into discipline theory and practice. We’ll cover the disciplinary framework to apply from minor misconduct to removable offenses\, and discuss how to select the appropriate penalty and ensure the employee with due process along the way. \nThursday\, February 12: Accountability for Conduct and Performance\, Part II \nAfter a discussion of disciplinary timelines\, documents\, procedures and Merit Systems Protection Board appeals\, the class switches focus to dealing with unacceptable performance and performance-based removal procedures. It includes a discussion about setting clear performance expectations\, clarifying vague performance standards\, implementing a performance Demonstration Period\, and the misunderstood “assistance” element required by law. \nLearning objectives\n\nIdentify the tools supervisors have for addressing misconduct and unacceptable performance.\nName the five elements of discipline and describe how the Douglas factors aid in selecting a defensible penalty.\nProperly implement a performance Demonstration Period (DP)\, often referred to as a PIP.\n\nNote: Participants will receive a copy of UnCivil Servant: Holding Federal Employees Accountable for Performance and Conduct\, 5th edition. Our experienced instructors will explain the foundations of the EEO process\, combined with the latest in EEO law in easy-to-understand terms and help you develop the skills necessary to be an effective counselor. \nMonday\, February 23: Introduction and the Role of the Counselor \nWhat makes a good counselor? What are the qualifications? This intro to counseling will provide the foundational guide to all steps of the EEO process\, including a look at the counselor’s role in alternative dispute resolution. \nLearning objectives \n\nDefine EEO terms such as basis\, pro se\, formal complaint\, and more.\nRecognize the roles and responsibilities of various offices within the agency.\nIdentify the purpose and proper approach for the EEO counselor.\n\nTuesday\, February 24: Theories of Discrimination \nWe dive into the various bases of discrimination and take a look at intentional discrimination based on race\, color\, and national origin; disparate impact; reasonable accommodation; hostile work environment harassment. \nLearning objectives \n\nExplain the structure of the EEOC and its jurisdiction.\nDifferentiate between circumstantial and direct evidence.\nDiscuss the various theories of discrimination.\n\nWednesday\, February 25: Interviewing for EEO Counselors \nAfter discussing the reprisal theory of discrimination\, this class provides an introduction to interviewing the counselee and the RMO.  We’ll share how to prepare for the interviews and identify the mistakes to avoid. \nLearning objectives \n\nIdentify the keys to interviewing the counselee.\nInterview challenging witnesses.\nExplain when a contractor is an employee for EEO purposes.\n\nThursday\, February 26: Writing the Report \nIt’s time to put what you’ve learned so far into practice.
