Claims of harassment and more specifically\, hostile work environment\, continue to soar in the Federal workplace\, along with confusion about what actions fit the legal definition. Plus\, with the recent rescission of the EEOC’s 2024 enforcement guidance\, you may have more questions than ever about workplace harassment. \nThis course examines how the rescission impacts existing case law\, clarifies emerging legal developments\, and much more. We’ll answer that question for you as we dive into MSPB and Federal Circuit lead cases in penalty determination. Discussion will include getting “intent” penalties off of “non-intent” charges\, proving harsh penalties off of vanilla charges\, penalty mitigation\, and more. \nThursday\, April 23:  Handling Unacceptable Performance\nThe focus shifts to unacceptable performance actions. We’ll discuss drafting defensible performance standards\, collecting proper documentation\, implementing a demonstration period (DP) or PIP\, defeating the performance rollercoaster\, and the impact of the 2021 Santos v. NASA decision. \nFriday\, April 24: Defending Against Whistleblower Reprisal Claims and other Affirmative Defenses\nMSPB Law Week closes with guidance on the complex issue of whistleblower reprisal complaints. We’ll cover the categories of protected disclosures\, actions that could constitute retaliation\, and the Carr analysis\, plus claims of harmful error\, reprisal for union activity\, and excessive penalty findings. \nLearning objectives\n\nDifferentiate between misconduct and unacceptable performance.\nAvoid common charging mistakes.\nConduct an effective Douglas factor analysis.\nRemove an unacceptable performer in 31 days.\nRecognize the categories of protected disclosures.\n\nNote: Participants will receive a copy of UnCivil Servant: Holding Federal Employees Accountable for Performance and Conduct\, 5th edition.
