SUMMARY:Get it Right the First Time: Accepting\, Dismissing\, and Framing EEO Claims
DESCRIPTION:A surprisingly large number of agency dismissals are overturned by the EEOC each year – and a remand years after the events in question can equal big problems when it comes to the investigation. This class covers all you need to know on when to accept\, when to dismiss\, and how to frame EEO claims. \nSometimes your agency has a responsibility to dismiss an EEO complaint. However\, you do so at your own risk. We will tackle the basis for dismissing claims\, review the legally protected categories\, and discuss how to spot and frame disparate impact\, hostile work environment\, and reasonable accommodation claims. We’ll also focus on reprisal\, timeliness principles\, and much more. And you’ll participate in an exercise to refresh what you’ve learned on the topic. \nLearning objectives\n\nIdentify claims that do not fall under the EEO process.\nAnalyze contractor EEO complaints.\nDraft legally sufficient acceptance and dismissal documents.\n\nEvent FAQs \nIs there any flexibility with course durations for Agency Direct training?  \nYes. Many agencies have requested that full-day courses be taught over two half-days to ensure maximum engagement\, especially when the course is being taught virtually. Any course can be spread out over multiple days or condensed into shorter sessions. DESCRIPTION:A Final Agency Decision is appealable\, by the complainant\, to the EEOC. And EEOC case law is filled with reversals of agency FADs that found no discrimination. This class will teach you how to write an effective and defensible FAD\, which requires thorough knowledge and understanding of discrimination law\, as it is uniquely applied to the Federal workplace. \nAttendees will learn all they need to know to write an effective FAD\, including identifying and avoiding the hazards that often lead to the EEOC reversals that plague so many agencies. And then after a discussion of timeliness issues\, we’ll dive into exercises including practice writing and deconstruction of an agency FAD. \nLearning objectives\n\nIdentify the statutory bases and theories of employment discrimination.\nEffectively compare and contrast in the “analysis” section.\nChoose words and phrases that make for a more effective and defensible FAD.\n\nEvent FAQs \nIs there any flexibility with course durations for Agency Direct training?  \nYes.
