A Final Agency Decision is appealable, by the complainant, to the EEOC. And EEOC case law is filled with reversals of agency FADs that found no discrimination. This class will teach you how to write an effective and defensible FAD, which requires thorough knowledge and understanding of discrimination law, as it is uniquely applied to the Federal workplace.
Attendees will learn all they need to know to write an effective FAD, including identifying and avoiding the hazards that often lead to the EEOC reversals that plague so many agencies. This class provides the fundamentals of discrimination law – the starting point if you want to avoid the common difficulties that lead to EEOC reversals.
Now it’s time to write the FAD. After a discussion of timeliness issues, we’ll dive into exercises, including practice writing and the deconstruction of an agency FAD.

Want to reduce conflict, increase productivity, and limit absenteeism, turnover, and even removals? That’s impossible, you say. Maybe not. Most Federal agencies settle employment disputes — whether they are initiated as grievances, EEO complaints, or appeals of agency disciplinary actions. While it’s common to assume that settlement means the agency has a flaw in its case, it has no direct tie to liability or admissions of wrongdoing. Often, it’s…

By Deborah J. Hopkins, July 14, 2026 Another week in America, and another politician is accused of sexual impropriety including sexual assault. And as always happens, strong feelings emerge from people in support of the alleged victim – and people in support of the alleged perpetrator. All before any investigation…
By Deborah J. Hopkins, July 7, 2026 It’s rare we at FELTG comment on proposed regulations – after all, proposed regulations are regularly changed, sometimes significantly based on public comment, before becoming final. It’s usually not worth getting all spun up over something that’s only at the proposal stage. That…
By Deborah J. Hopkins, June 23, 2026 Sometimes, an employee suffers from a medical condition that renders him unable to work. It’s sad when this happens, but it also requires the agency to take action because presumably the agency needs someone in the position who can actually perform the work.…
By Deborah J. Hopkins, February 10, 2026 Last summer OPM issued a memorandum, Performance Management for Federal Employees (OPM Memo), as part of its goal to deliver a “high-performance, high-accountability culture in the Federal workforce.” We covered the guidance in detail in a training a few weeks later, and one…
