An employee does not follow an order. Seems like an open-and-shut case of insubordination, right? Think again. Was it a refusal or simply a failure to comply? When you charge an employee with insubordination, you must prove intent along with the other elements of the charge.
This class explains what it takes for insubordination charges to succeed and provides alternative charges that may be more appropriate, depending on the situation. It will also discuss when an employee legally can – and can’t – refuse to follow a supervisor’s instruction.
