An increase in reasonable accommodation requests based on religion, disability, and pregnancy. Continued focus of diversity, equity, inclusion and accessibility (DEIA). FELTG’s EEOC Law Week runs the gamut of EEO issues, providing usable and up-to-date guidance for all practitioners, regardless of experience level.

What Exactly is Undue Hardship Anymore?

Course Description:The Supreme Court upended decades of precedent in its unanimous decision Groff v. DeJoy. This is a big change for the concept of undue hardship in religious accommodation, experts say. But is it really? And how does it differ when it comes to reasonable accommodations for disability or pregnancy? Mr. Woods will deconstruct the distinctions between accommodations and explain the legal ramifications of each. Earn 2 CLE credits.

Course description: Employee Engagement (EE) is vital to meet today’s challenges in the Federal workplace. Each year, agencies receive an EE score, based upon a survey done months before. The data is limited, particularly for regulatory organizations in the spotlight. This course describes the limitations of the EE score and examines the link between engagement, motivation, and leveraging employees’ strengths. Participants will explore realistic strategies for increasing engagement and creating tailored, timely measures of EE.

Say Whaaat?!? Respectful Communication in the Workplace

Course description: Subtle and overt language, joking, off-handed comments, and offensive comments and gestures can lead to a hostile work environment. And that includes ill-advised, even if not ill-intentioned, phrases such as “hold down the fort” and “low man on the totem pole.” Being a respectful communicator means more than just not offending anyone, it also means taking preventive measures to tailor your communication to avoid misunderstandings, irrespective of the cultural and ethnic differences that we all bring into the workplace. Roslyn Brown will not only explain why certain phrases are troublesome but show you what to do when something offensive is said. 2

Session 2: Understanding Harassment and Planning the Investigation

Course description: What is the scope of the investigation? Who should you interview? What documents are you going to need? Preparing your investigative plan is a critical step in developing a legally sufficient investigation. Attorney Katherine Atkinson will explain the proper role of the investigator and how you can avoid the pitfalls of an insufficient investigation with the proper preparation and knowledge. Plus, she’ll answer important questions about representation: Does the witness have the right to a representative? Does the union have a right to attend the interview – even if the witness doesn’t want the union there? What rights does agency management have in the process?

Course description: Attorney Katherine Atkinson will share legal principles and proven guidance to navigate this most critical and challenging part of harassment investigations: conducting the interviews and gathering relevant evidence. Attendees will leave the session with techniques for questioning, tools for reading body language, suggestions on how to handle difficult personality types, and tips for writing the fact-finding report (FFR) and report of investigation (ROI). Ms. Atkinson will also share how technology is changing the investigation process, including a timely discussion of conducting virtual interviews.

Virtual Training Event – Bad Detective: The Mistakes That Hamper Agency Investigations

Maybe you envision yourself donning a Sherlock Holmes hat and cape. Or, perhaps, your model is the masterful Benoit Blanc of Knives Out Mystery fame. If only the work of a Federal administrative investigation was as easy as these fictional detectives make their jobs seem. Instead, there are more than enough opportunities for you to come out looking like a bumbling Inspector Clouseau.

During her distinguished Federal (and post-Federal) career, Roslyn Brown has seen her fair share of investigations that have gone the wrong way. It could be an investigator’s failure to interview certain witnesses, a failure to take a complainant’s statement into account, or, perhaps, an action, such as a widely shared email, that shows a lack of objectivity. An investigator’s failure to stay up to date with case law could sink a case, as could the inability to meet your deadlines.

Over the course of an afternoon, Ms. Brown will provide guidance on how to conduct a timely and effective investigation, while identifying the pitfalls that have doomed such efforts in the past.

Virtual Training Event – Writing Final Agency Decisions

Course Description

Final Agency Decision sounds so, well, “final.” But it most definitely is not. A FAD is appealable, by the complainant, to the EEOC. And many employees have and will continue to take advantage of that opportunity to appeal the agency’s decision. Undoubtedly, remote workers have enjoyed the therapeutic benefits that come with owning a pet. But does that make their new furry friends therapy or emotional support animals? And can no-longer-remote employees bring their new four-legged (or sometimes two-legged, or no-legged) friends to the workplace? In most cases, the answer is an easy no. But if it’s a reasonable accommodation request, the answer isn’t quite as definitive. The EEOC’s stance that an emotional support animal may be a required reasonable accommodation for a qualified individual with a disability, even if it is not a trained service dog, fails to provide an easy answer.

Not everyone has the same definition of “harassment.” While most professionals recognize harassment that violates Title VII, some employees consider it harassment when supervisors provide critical performance feedback or assign work.  And, in between, there are threatening, intimidating, and disturbing acts that are unrelated to protected classes, but nonetheless may be non-EEO harassment and must be addressed as misconduct. Virtual Training Event – Advanced EEO: Navigating Complex Issues

A supervisor sees his employee going into an investigation interview and says, “Just don’t play the race card.” An employee, who was provided new software as a reasonable accommodation, tells you weeks later that her computer has “been glitchy” since the new software was added.

When EEO challenges arise, they rarely show up as run-of-the-mill simple scenarios you’ve worked through in a training class. Are you an EEO professional, attorney or advisor eager to learn how to more effectively manage the unexpected EEO issues? Whether you’re representing your agency before the Merit Systems Protection Board or the Equal Employment Opportunity Commission, there is one ultimate goal: Win the case. There is no other class that will prepare you better for these kinds of hearings. FELTG Instructor Katherine Atkinson is an experienced litigator. She will walk you through each step of the process from the acknowledgement order through your closing statement, to ensure that you meet that ultimate goal.

Course Description

This week of FELTG training focuses on conducting administrative investigations in the Federal workplace with an emphasis on employee misconduct, including workplace harassment. After an overview of the substantive law, participants will learn procedures and best practices for conducting administrative investigations, including understanding what constitutes misconduct, the differences between EEO and non-EEO harassment, planning the investigation, fact finding, collecting evidence, dealing with witnesses, understanding types of questioning, and testifying at hearing. The week concludes with a day focused on writing an investigative report.

Special content will also discuss conducting investigations post-pandemic, including tips for interviewing witnesses virtually, addressing safety concerns during in-person interviewing and evidence gathering, and more.

The Federal hiring process is a challenging one that requires patience. Those who hurry the hiring process are not only likely to make a mistake in hiring, but they may also end up without sufficient documentation to combat a discrimination complaint, making the allegation difficult to defend against.

And there is NO excuse these days for having any steps in your hiring process that could be discriminatory. Per Executive Order, your agency should have already taken steps to “advance diversity, equity, inclusion, and accessibility,” and “eliminate, where applicable, barriers to equity, in Federal workforce functions.”

Regardless of where you are in the development of an agency Diversity, Equity, Inclusion, and Accessibility (DEIA) plan or whether your agency is even currently hiring, this half-day virtual training provides important guidance that you cannot afford to miss if you want to ensure your hiring practices are nondiscriminatory and align with the Federal merit system principles.

Virtual Training Event – Get it Right the First Time: Accepting, Dismissing and Framing EEO Claims

It could be a timeliness issue, failure to state a claim, or something else. Sometimes your agency has a responsibility to dismiss an EEO complaint. However, you do so at your own risk. A surprisingly large number of agency dismissals are overturned by the EEOC each year – and a remand years after the events in question can equal big problems when it comes to the investigation.

How do you balance the obligation to dismiss faulty complaints without unlawfully stripping someone of their rights to the EEO process and ending up on the wrong side of an EEOC decision in the process?

Join FELTG Instructor Katherine Atkinson for this two-day look into the core of the complaint process — determining whether to accept or dismiss an EEO claim. Ms. Atkinson will review the lawful reasons for dismissing a claim and how to make that determination. She’ll also take you through the process of spotting and framing claims based on each of the theories of discrimination.

This class will have interactive polling and plenty of opportunities to ask specific questions. And before the training ends, you’ll participate in an exercise to refresh what you’ve learned about acceptance/dismissal.

Most people attend both training days, but you may attend either day independently.

Standard Tuition (register October 1-31):

  • 2 days = $925

  • Can I attend Virtual Training from my government computer?
    • FELTG uses Zoom for this Virtual Training Institute event. Many government computers and systems allow Zoom access. If for some reason your firewall will not allow access, you’re welcome to use your personal email address to register, and to attend the sessions from your personal device.
  • Can I earn CLE credits for this class?
    • CLE applications are the responsibility of each attendee; FELTG does not apply for the credits on behalf of attendees.  If you are seeking CLE credit, attendees may use the materials provided by FELTG in submission to your state bar. Attendees may also request a certificate of completion which will contain the number of training hours attended.
  • Can I share my access link with co-workers?
    • No. Registration for this event is per individual, and access links may not be shared. Each link may only be used by one person.
  • Can I register a teleworker?
    • This event is individual registration, so the cost is the same whether the person is teleworking or in an agency facility.
  • How do I receive a group rate discount?
    • Group rates are available for agencies registering 10 or more individuals for the full event. Group discounts are available through September 30.

Cancellation and No-show Policy for Registered Participants: Cancellations made after the cancel date on the registration form will not be refunded or given credit toward future courses. Pre-paid training using the “Pay Now” option will not be refunded or given credit toward future courses. No-shows will not be refunded or given credit toward future courses.

Virtual Training Event – Writing Final Agency Decisions

Course Description

Final Agency Decision sounds so, well, “final.” But it most definitely is not. A FAD is appealable, by the complainant, to the EEOC. And many employees have and will continue to take advantage of that opportunity to appeal the agency’s decision. And here’s the thing: The EEOC’s decisions are filled with reversals of the agency’s FAD, finding no discrimination.

How do you avoid such a disappointing decision?

Learn how to write an effective final agency decision. To do that requires a knowing and understanding of discrimination law, as it is uniquely applied to the Federal workplace.

That’s what FELTG Instructor and Attorney at Law Katherine Atkinson will teach you over two half-days of virtual training. Attendees will leave with all they need to know to write an effective FAD, including identifying and avoiding the pitfalls that often lead to the EEOC reversals that plague so many EEO professionals.

This program meets the President’s mandate to provide training on diversity, equity, inclusion and accessibility in the Federal workplace.
