Whether you’re ready for it or not, many employees are returning to the physical workplace in large numbers. Several agencies have already started the process, and others have hybrid work plans in place. Based on the early results, it’s not been an easy transition for most. And it sure as heck isn’t going to get easier anytime soon.

Rather than bringing people together to fight a common cause, the pandemic widened the deep politicization in this country, which, unfortunately, has filtered into workplaces. That conflict remains as employees return — a good number of them reluctantly. And the conflicts won’t automatically disappear, even if some employees work remains remote or evolves into hybrid.

Are you prepared to identify and handle expected increases in COVID-related reprisal and harassment? What about the expected in increase in reasonable accommodation requests? Or the potential for harassment and other misconduct?

This is the only Federal workplace-specific virtual training event that will address all of these employment law-related challenges, provide clear-cut guidance along with the appropriate framework for you to address these unique challenges. Course Description

Whether you’re representing your agency before the Merit Systems Protection Board or the Equal Employment Opportunity Commission, there is one ultimate goal: Win the case. There is no other class that will prepare you better for these kinds of hearings. FELTG Instructor Katherine Atkinson is an experienced litigator. She will walk you through each step of the process from the acknowledgement order through your closing statement, to ensure that you meet that ultimate goal. 

On the first day, Ms. Atkinson will share strategies for developing a theory of the case, and offer guidance for the process including discovery, depositions, and motions practice. The second day will focus on developing the record, plus offer tips on litigation techniques to improve your skills – and make your position stand out. When President Biden took office, he issued a flurry of Executive Orders that made it clear diversity, equity, inclusion, and accessibility (DEIA) are priorities in the Federal Workplace.

It’s now 20 months later: Have you done anything to advance DEIA at your agency? And, if so, what were the results?

Webinar – The Role of the Douglas Factors in Arbitration

Course Description

When faced with a case involving appealable adverse actions, an arbitrator must apply the same substantive standards as the Merit Systems Protection Board. The arbitrator must decide whether discipline was appropriate, and also assess whether the agency considered the relevant factors in determining the penalty. Just like an MSPB judge, the arbitrator has the authority to mitigate the penalty if it is outside the bounds of reasonableness. In this 60-minute webinar, Joe Schimansky will explain how the Douglas Factors came about and provide a detailed look at the role those factors play in the arbitration process.

Attendees will learn how to:

  • Identify all 12 Douglas Factors.
  • Determine whether the Douglas Factors have been appropriately considered.
  • Explain how the factors apply in the circumstances of a particular case, and how to educate the arbitrator who may be unfamiliar with the Douglas framework.

Course description: What is the scope of the investigation? Who should you interview? What documents are you going to need? Preparing your investigative plan is a critical step in developing a legally sufficient investigation. Attorney Katherine Atkinson will explain the proper role of the investigator and how you can avoid the pitfalls of an insufficient investigation with the proper preparation and knowledge. Plus, she’ll answer important questions about representation: Does the witness have the right to a representative? Does the union have a right to attend the interview – even if the witness doesn’t want the union there? What rights does agency management have in the process?

Final Agency Decision sounds so, well, “final.” But it most definitely is not.  A FAD is appealable, by the complainant, to the EEOC. And many employees have and will continue to take advantage of that opportunity to appeal the agency’s decision. And here’s the thing: The EEOC’s decisions are filled with reversals of the agency’s FAD, finding no discrimination.

How do you avoid such a disappointing decision?

Learn how to write an effective final agency decision. To do that requires a knowing and understanding of discrimination law, as it is uniquely applied to the Federal workplace.

Recreational marijuana is legal in over a dozen states and the District of Columbia, and its use for medical purposes is now legal in 30-plus states. What does that mean for Federal workers in those locations? Could their careers still go up in smoke for a “legal” activity? Are you required to accommodate an employee’s medically certified marijuana usage? What should you do if the Federal employee is married to someone who legally grows marijuana? Two years ago, the Office of Personnel Management’s updated regulations to build on President Trump’s Executive Order 13839 took effect. Three months later, President Biden issued Executive Order 14003, which revoked EO 13839. With no new OPM regulations, confusion had settled in.

But on November 10, 2022, OPM released its final regulations implementing Executive Order 14003, and they go into effect December 12. The regs provide guidance on whether you:

  • Can use clean-record agreements in settlements.
  • Must notify employees that their probationary period is ending.
  • Should provide assistance to employees on performance demonstration periods.
  • Are required to use progressive discipline in cases of employee misconduct.

Antisemitism is never acceptable. However, recent remarks by celebrities, athletes, and news networks have made antisemitism seem more commonplace, in all facets of life, including the workplace. Title VII makes it illegal to discriminate against someone based on, among other things, religion. However, this is one of the protected categories least understood.

In this 60-minute webinar, FELTG Instructor Katherine Atkinson will explain these Title VII protections. Ms. Atkinson will also provide guidance on how to ensure that individuals in protected categories are not discriminated against, with a specific focus on harassment and discrimination against Jewish employees.

Virtual Training Event – Drafting Enforceable and Legally Sufficient Settlement Agreements

Most disputes in federal agencies settle employment disputes — whether they initiate as grievances, EEO complaints, or as appeals of agency disciplinary actions. While it’s common to assume that settlement means the agency has a flaw in its case, it has no direct tie to liability or admissions of wrongdoing. Often, it’s the most efficient and effective way to handle a dispute and allow you to get back to focusing on your agency’s mission.

During this interactive half-day virtual training, Bob Woods will discuss the roles and responsibilities of individuals involved in settlement discussions, and will cover considerations for why and when to consider settlement as an option. In addition, he’ll explain concepts including confidentiality, legality, and enforceability.

Mr. Woods will also cover specific settlement terms that may be negotiated including references, compensatory damages, reinstatement or promotions, modifications to benefits, clean records, and more.

If you’ve attended FELTG accountability training, you know the numerous pitfalls that can derail an agency’s disciplinary action, whether it’s suspension, demotion, or removal. Late last year, OPM issued regulations that removed a prohibition on clean record agreements, returning to agencies a tool “to resolve informal and formal complaints.” It is one of many alternative disciplinary tools Federal supervisors have. In this two-hour virtual training, FELTG President Deborah J. Hopkins will explain why, how, and when to use numerous alternative actions, including not just clean record agreements, but also:

  • Last chance agreements
  • Last rites agreements
  • Paper suspensions
  • Reprimands in lieu of suspensions
  • And more

The goal of discipline is to rehabilitate. In certain circumstances, alternative sanctions are the more effective approach. You’ll leave this session knowing how to identify the right disciplinary alternative for your situation and the appropriate steps to see it all the way through successfully. Attendees will learn how to:

  • Appropriately draft documents for alternative discipline.
  • Explain the difference between last chance agreements and last rites agreements.
  • Discuss the benefits of reprimand in lieu of suspension.

Virtual Training Event – Discovery Done Right: Avoiding Sanctions Before the MSPB and EEOC

Discovery is a critical and effective part of any litigation – when conducted properly. Annoying and abusive discovery techniques could have negative consequences, and possibly even lead to sanctions. From disrespect and profanity in depositions to the other party refusing to produce requested documents, it’s important to be prepared for any situation. In this half-day class, Attorney at Law Katherine Atkinson will provide you with a grounding in the Federal Rules of Evidence, as well as the procedural methods for the MSPB and EEOC. Ms. Atkinson will offer guidance on all forms of written discovery – interrogatories, document requests, depositions, and requests for admission – and she’ll review possible sanctions and how best to avoid them.

  • Most effectively request and respond to requests for written discovery.
  • Recognize actions that could lead to sanctions.

Employee needs, physical conditions, and medication adjustments evolve over extended periods. Once successful accommodations may no longer be effective.
