Course Description
Final Agency Decision sounds so, well, “final.” But it most definitely is not. A FAD is appealable, by the complainant, to the EEOC. And many employees have and will continue to take advantage of that opportunity to appeal the agency’s decision. And here’s the thing: The EEOC’s decisions are filled with reversals of the agency’s FAD, finding no discrimination.
How do you avoid such a disappointing decision?
Learn how to write an effective final agency decision. To do that requires a knowing and understanding of discrimination law, as it is uniquely applied to the Federal workplace.
That’s what FELTG Instructor and Attorney at Law Katherine Atkinson will teach you over two half-days of virtual training. Course Description
Undoubtedly, remote workers have enjoyed the therapeutic benefits that come with owning a pet. But does that make their new furry friends therapy or emotional support animals? And can no-longer-remote employees bring their new four-legged (or sometimes two-legged, or no-legged) friends to the workplace? In most cases, the answer is an easy no. But if it’s a reasonable accommodation request, the answer isn’t quite as definitive. The EEOC’s stance that an emotional support animal may be a required reasonable accommodation for a qualified individual with a disability, even if it is not a trained service dog, fails to provide an easy answer.

Course Description
Neurodiversity refers to the diversity in how people think, learn, and behave – it’s the idea that people interact with their environment in many ways. Neurodiversity is also inclusive of individuals with learning differences, autism spectrum disorders, or other neurological or developmental conditions such as ADHD.
Research estimates that around 1 percent of the population has an autism spectrum disorder, between 5-9 percent are estimated to have a learning disability and just under 10 percent have a diagnosis of ADHD. The ability to recruit and retain neurodivergent employees will make your agency more diverse — and effective.
In this two-hour virtual training event, FELTG Instructor Shana Palmieri, LCSW will provide an overview of diagnoses that fall under the term “neurodivergence” and share guidance on how to best create an inclusive workplace.

Course Description
Not everyone has the same definition of “harassment.” While most professionals recognize harassment that violates Title VII, some employees consider it harassment when supervisors provide critical performance feedback or assign work. And, in between, there are threatening, intimidating, and disturbing acts that are unrelated to protected classes, but nonetheless may be non-EEO harassment and must be addressed as misconduct. This program will not only identify the lines that separate these different levels of harassment both perceived and real, but also explain how and when to address harassment as misconduct.

Course Description
A supervisor sees his employee going into an investigation interview and says, “Just don’t play the race card.” An employee, who was provided new software as a reasonable accommodation, tells you weeks later that her computer has “been glitchy” since the new software was added.
When EEO challenges arise, they rarely show up as run-of-the-mill simple scenarios you’ve worked through in a training class. Are you an EEO professional, attorney or advisor eager to learn how to more effectively manage the unexpected EEO issues? Are you looking for guidance to answer challenging questions, such as: Can an agency be held liable for retaliation in a disciplinary action if the deciding official was unaware of the employee’s prior protected activity? There is no reason to fear the reasonable accommodation process. Yet many Federal supervisors do. They’re not alone. Reasonable Accommodation Coordinators, HR and EEO professionals, program managers and even attorney/advisors have approached reasonable accommodation requests with a bit of trepidation.
FELTG’s annual Reasonable Accommodation webinar series returns in 2024 with all-new updates, laying the important groundwork to make the process of managing requests for accommodation (for disability, pregnancy, or religion) a positive one – for you, the employee, and the agency.

Whether it’s a disgruntled employee or customer, or a domestic issue that follows an employee to work, workplaces are at a distinct risk of violent incidents. And that risk is heightened when it’s a Federal workplace. Earlier this year, Attorney General Merrick Garland announced a “deeply disturbing spike” in threats against Federal workers.
How do you prepare yourself to protect the lives of those around you? Are there risk factors that might give you an indication of when someone will become violent? What can you do to help prevent a violent tragedy occurring where you work?
This topic is too important to ignore. FELTG Instructor Shana Palmieri, LCSW will present Assessing Risk and Taking Action: Threats and Violence in the Federal Workplace. Ms. Palmieri, who specializes in mental health and handled the aftermath of the Navy Yard shooting in 2013, will cover:
- Warning signs that violence may be imminent, and dynamic risk and protective factors for workplace targeted violence
- Creating an internal threat assessment investigation
- Equipping Threat Management Teams to respond to threats or violent acts
- Understanding the personality traits and cognitive issues that contribute to violent behavior – and those that don’t

Robust. Uninhibited. Wide-open. These are words the U.S. Supreme Court used to describe the type of debate by union officials that is considered “protected activity.” But how robust, uninhibited or wide open? And when? Those are the questions that Ann Boehm will answer during this training.
There are many tales of profanity, shouting, rough speech, and bullying taking place between union reps when performing representational duties — and not just during negotiations. Ms. Boehm will share several cases that highlight robust activity that were considered “protected activity” and provide details of FLRA decisions that illustrate behavior that very clearly crossed the line into misconduct.

Course Description
Final Agency Decision sounds so, well, “final.” But it most definitely is not. A FAD is appealable, by the complainant, to the EEOC. And many employees have and will continue to take advantage of that opportunity to appeal the agency’s decision. And here’s the thing: The EEOC’s decisions are filled with reversals of the agency’s FAD, finding no discrimination.
How do you avoid such a disappointing decision?
Learn how to write an effective final agency decision. To do that requires a knowing and understanding of discrimination law, as it is uniquely applied to the Federal workplace.

- Can I attend Virtual Training from my government computer?
- FELTG will use Zoom for this Virtual Training Institute event. Many government computers and systems allow Zoom access. If for some reason your firewall will not allow access, you’re welcome to use your personal email address to register, and to attend the sessions from your personal device.
- What if I want to attend a session but have a schedule conflict?
- FELTG plans to offer this live event periodically, so check our calendar for upcoming dates.
- Can I share my access link with co-workers?
- No. Registration for this event is per individual, and access links may not be shared. Each link may only be used by one person.
- Can I register a teleworker?
- This event is individual registration, so the cost is the same whether the person is teleworking or in an agency facility.
- How do I receive a group rate discount?
- If an agency wishes to register 10 or more attendees for the full event, a group discount will be applied if all registrations are received and paid for together. Group discount deadline is October 18.
- Can I earn CLE credits for this class?
- CLE applications are the responsibility of each attendee; FELTG does not apply for the credits on behalf of attendees. If you are seeking CLE credit, attendees may use the materials provided by FELTG in submission to your state bar. Attendees may also request a certificate of completion which will contain the number of training hours attended.
Cancellation and No-show Policy for Registered Participants: Cancellations made after the cancel date on the registration form will not be refunded or given credit toward future courses. Pre-paid training using the “Pay Now” option will not be refunded or given credit toward future courses. No-shows will not be refunded or given credit toward future courses.
