As an Employee Relations Specialist, you have a challenging job, and you never know just what personnel challenges might find a spot on your ever-increasing “to do” list.

This seminar starts by grounding the student in the laws, regulations and policies associated with job functions, and provides an explanation on how ER fits within the agency’s greater HR function. After the basics, we’ll dive in to a number of unique topics, which include (but definitely are not limited to) performance plans, standards and recognition; hours of work — including overtime and compensatory time; pay and RIFs; furloughs; handling specific disciplinary situations; leave – including types, accrual, FMLA, military leave and leave stacking; involuntary separations; dispute resolution; EAPs; medical issues and injury compensation; drug testing; plus basic EEO information – including disparate treatment, disparate impact and reasonable accommodation.

Course Description

If one of your agency’s employees had a mental health crisis in the workplace, would you know what to do? And considering most employees are still working remotely, how would you even know?

Almost 18 percent of all adults have a mental illness diagnosis at some point in their lives. The COVID-19 pandemic has exacerbated the ongoing mental health crisis in this country. Earlier this year, OPM released a memo on the importance of mental health and the well-being of Federal employees: “Awareness of mental health supports for Federal employees is an important element of protecting employee well-being and sustaining a high performing Federal workforce.”

This virtual training program will provide highly practical guidance and straight-forward advice on dealing with the very unique challenges you face at this time. Licensed Clinical Social Work Shana Palmieri will de-stigmatize the truth about “mental illness” and will explain the impact various mental health conditions have on individuals, and those they work with. She’ll also provide strategies for effectively supervising and managing employees with these conditions, even as they work remotely.Ms. Palmieri will answer challenging questions, such as:

  • What do you do if you suspect a mental health crisis and the employee won’t answer his phone?
  • How do you provide constructive criticism to someone who exhibits narcissistic behavior?
  • If you suspect that one of your employees has a mental impairment, what can you do beyond directing them to EAP?
  • What are the symptoms of a personality disorder?

Attendees will learn how to walk the tenuous line between providing accommodations and support for a mental health condition and holding employees accountable for their work performance. Attend this timely virtual training event and learn strategies to:

  • Improve performance and success for employees with mental health conditions.
  • Communicate effectively with all employees.

The world of Federal EEO is constantly changing. With the expected deluge of complaints related to vaccine exemption denials, it’s also expected to get much more challenging in the next few months. Agencies will be onboarding new EEO counselors, and need to make sure they’re prepared for the unique challenges 2022 is sure to bring. FELTG has the solution — the most engaging, up-to-date, and comprehensive 32-hour EEO Counselor initial training available.

President Biden’s Executive Order requires all Federal employees to be vaccinated with no option for regular coronavirus testing to opt out of the mandate. What does this mean for employees who refuse to get vaccinated? Are there any religious exemptions that would allow employees to continue to work without vaccination? What about employees who cannot get vaccinated due to a disability – can agencies accommodate them?

Attorney Katherine Atkinson will not only share with you the latest guidance from the president’s EO, the EEOC and the CDC, but she will also explain how applying the basic EEO framework can answer the aforementioned and other puzzling EEO questions you may suddenly face. Because Ms. Atkinson will use a legal analysis to address these challenges, the answers and guidance you receive during this virtual training will be useful long after the coronavirus is gone.

Beyond the vaccination mandate, Ms. Atkinson will also help you answer the following questions and more:

Santos, OPM and Performance Accountability: What Gives?
Presented by Robert Woods, Attorney at Law, FELTG Instructor

 

Course Description: Last year, the Federal Circuit in Santos v. NASA undid more than 40 years of case precedent, requiring agencies to have substantial evidence of poor performance before they can place an employee on a PIP. Yet, OPM’s proposed regulations, while not yet final, seem to indicate that employees must first be notified and given an opportunity to improve. Don’t let these seemingly contradictory approaches keep you from taking appropriate action. Attendees will leave this session with clear guidance and an effective approach for placing an employee on notice about unacceptable performance and explaining to the employee what’s required next. Course description: Leave is an ever-changing topic and 2022 is no exception.  The passage of the NDAA for FY 2022 created a new type of leave: Parental Bereavement Leave will allow for two weeks of paid time off in the event of death of a son or daughter.  The devil, of course, is in the details.  Which employees are covered?  How is son or daughter defined?  As if that wasn’t enough, the NDAA for FY 2021 made a change to the type of service that is qualifying to become FMLA eligible, and the regulations implementing the Paid Parental Leave Act issued in 2020 made some changes to the basic FMLA entitlement.  The session will cover these changes, as well as leave in COVID-related situations. Reasonable accommodations should be determined by the employee and the agency, through what those of us in the business call “the interactive process.”

After the success of two years of pandemic-induced remote work, you better believe that you’ll be getting even more reasonable accommodation requests for telework as employees are directed to return to the physical workplace. Are you ready to do the appropriate interactive discussion and analysis?

Join FELTG President and Attorney at Law Deborah Hopkins for a discussion on this timely topic, during the third event in our Reasonable Accommodation in the Federal Workplace webinar series. Make Your Best Case: Effectively Preparing Performance Narratives

Preparing performance narratives can be tough. It’s a lot of writing, sometimes it’s hard to make the documentation you have fit what was written in the performance plan, and sometimes you know there’s going to be a fight about what you put down on that form. It may be the employee who thinks the rating should be higher. Sometimes, it’s a reviewer who doesn’t necessarily see your employee’s performance at the same level as you do. And, in some agencies, there are review panels that may be scouring your documentation. FELTG Senior Instructor Barbara Haga provides guidance to make preparing performance narratives less tough – and more effective.

What You Think You Know About AWOL is Probably Wrong

You can’t discipline an employee for AWOL unless it has reached a certain number of days. Employees can’t be removed for AWOL. You can’t be charged AWOL for time that you were physically present in the office. None of these statements is true; they are AWOL myths. During this presentation, FELTG President Deborah Hopkins will shatter those myths and provide you with clear guidance on how to handle situations when an employee doesn’t show up for work. She’ll also explain the difference in AWOL as a charge and AWOL as a non-pay status, and provide strategies on how to handle employees who don’t report for duty.

Other Types of Harassment: Beyond Discriminatory and Sexual Harassment

Course description: What is the scope of the investigation? Who should you interview? What documents are you going to need? Preparing your investigative plan is a critical step in developing a legally sufficient investigation. Attorney Katherine Atkinson will explain the proper role of the investigator and how you can avoid the pitfalls of an insufficient investigation with the proper preparation and knowledge. Plus, she’ll answer important questions about representation: Does the witness have the right to a representative? Does the union have a right to attend the interview – even if the witness doesn’t want the union there? What rights does agency management have in the process?

Final Agency Decision sounds so, well, “final.” But it most definitely is not.  A FAD is appealable, by the complainant, to the EEOC. And many employees have and will continue to take advantage of that opportunity to appeal the agency’s decision. And here’s the thing: The EEOC’s decisions are filled with reversals of the agency’s FAD, finding no discrimination.

How do you avoid such a disappointing decision?

Learn how to write an effective final agency decision. To do that requires a knowing and understanding of discrimination law, as it is uniquely applied to the Federal workplace.

GEAR initiative and other efforts focused on modifying Federal performance management system. Linkage between appraisal and other personnel management decisions, including reduction-in-force and within-grade increases. Writing effective and measurable performance criteria that will withstand third-party review, including a workshop where participants will do an in-depth review of performance plans. Requirements for successful performance-based actions – from drafting a PIP notice that will withstand scrutiny to conducting a bona fide PIP to ensuring that due process is met in effecting an action on unacceptable performance.

Two years ago, the Office of Personnel Management’s updated regulations to build on President Trump’s Executive Order 13839 took effect. Three months later, President Biden issued Executive Order 14003, which revoked EO 13839. With no new OPM regulations, confusion had settled in.

But on November 10, 2022, OPM released its final regulations implementing Executive Order 14003, and they go into effect December 12. The regs provide guidance on whether you:

  • Can use clean-record agreements in settlements.
  • Must notify employees that their probationary period is ending.
  • Should provide assistance to employees on performance demonstration periods.
  • Are required to use progressive discipline in cases of employee misconduct.

Webinar – Make Your Best Case: Effectively Preparing Performance Narratives

Preparing performance narratives can be tough. It’s a lot of writing, sometimes it’s hard to make the documentation you have fit what was written in the performance plan, and sometimes you know there’s going to be a fight about what you put down on that form. In certain instances, it’s the employee who thinks the rating should be higher. Other times, it’s a reviewer who doesn’t necessarily see your employee’s performance at the same level as you do. And, in some agencies, there are review panels that may be scouring your documentation.

Performance Management: Managing performance from system establishment to conducting annual appraisals to taking actions linked to performance. GEAR initiative and other efforts focused on modifying Federal performance management system. Requirements for performance plans, including design of agency systems, rating schemes, and procedures for conducting appraisals. Linkage between appraisal and other personnel management decisions, including reduction-in-force and within-grade increases. Writing effective and measurable performance criteria that will withstand third-party review, including a workshop where participants will do an in-depth review of performance plans. The reasonable accommodation process starts with a request from an employee or applicant. However, that request does not need to be in writing or be formalized in any certain way. In fact, an agency cannot require that a request for reasonable accommodation even include the words “ADA,” “request,” or even “reasonable accommodation.”

Heck, the request doesn’t even have to come from the employee.

If a employee makes a reference to a need for an adjustment or change and it’s related to a medical condition, then you have a request for reasonable accommodation.

During this training, you’ll receive guidance on how to “spot” a reasonable accommodation request, discuss the importance of having a reasonable accommodation policy, and provide examples of each.

Agencies must accommodate qualified individuals with disabilities unless doing so would be an undue hardship. But what constitutes “undue hardship?” It’s a term of art that’s not so easily defined. And since it’s the only “statutory limitation on an employer’s obligation to provide reasonable accommodation,” the undue hardship claim is one that’s often misunderstood and misused.

The Post-pandemic Federal Workplace: Telework and Hybrid Work Challenges

The pandemic has likely forever changed the Federal workplace. More employees (and applicants) than ever before not only want to work remotely but expect to. In an effort to bring some employees back to their physical workspace, the “hybrid” workplace has become the norm for most Federal agencies.

With some people working remotely and others onsite, how do you ensure that you hold all employees accountable for performance – and how do you ensure that it’s done fairly? And how do you handle the increasing number of requests to telework, especially those citing the request as an accommodation for a disability?

Some employees will struggle regardless of whether they’re at home or in an office. Using framework from FELTG’s flagship course UnCivil Servant: Holding Employees Accountable for Performance and Conduct, Ann Boehm will provide guidance on swiftly and effectively addressing unacceptable performance, regardless of where the employee is working. Plus she’ll discuss setting expectations and monitoring performance of employees who aren’t onsite.

She’ll also leave you with a path to determine when to say yes to a request for reasonable accommodation to telework – and when to say no.  Find out what the EEOC says about accommodating an employee’s commute and what to do if telework would be an effective accommodation, but another accommodation would work too.

Charges and Penalties Under the New MSPB

If you’ve been in the business for more than a few days, you know the importance of drafting legally sufficient disciplinary charges and making a defensible penalty determination. Yet many agencies still lose cases because of poorly drafted charges, or inadequate Douglas factor penalty assessments.

FELTG President Deborah J. Hopkins will cover the art and science behind drafting disciplinary charges, including the types of charges, parts of a charge, how charges are interpreted, and alternative charges. From there the discussion will cover the factors required to determine an appropriate penalty for employee misconduct. We’ll also look at how the current MSPB views charges and penalties by deconstructing recent cases they’ve issued.

Attendees will learn how to:

  • Determine what charges to use based on the circumstances.
  • Defend the reasonableness of the penalty using the Douglas Factors.
  • Increase their chances of penalty deference based on this Board’s view on penalty assessment.

Successful Hiring: Effective Techniques for Interviewing and Reference Checking

The Federal hiring process requires patience. If you’ve finally been granted approval to fill a position, you may be tempted to get someone hired as quickly as possible.

This interactive training will prepare supervisors and managers for conducting legal and successful job interviews, and will help agency advisors who assist managers in the hiring process. Barbara Haga will share guidance on how to make the most out of interviewing and checking references, from crafting an accurate position description, to asking the right questions, to assessing a candidate’s ability to perform the job. Ms. Haga will also throw back the curtains on perennial questions, such as: Are we required to interview all candidates? Do we have to ask all candidates the same exact questions? How do you use behavior-based questions to get answers about depth of experience or knowledge? What can or can’t you ask during a reference check?

Attendees will learn how to:

  • Prepare defensible questions for applicants.
  • Identify hiring practices that work and those to avoid.
  • Get critical job-related information from current and past supervisors.

Bad Detective: The Mistakes That Hamper Agency Investigations

Maybe you envision yourself donning a Sherlock Holmes hat and cape. Or, perhaps, your model is the masterful Benoit Blanc of Knives Out Mystery fame. If only the work of a Federal administrative investigation was as easy as these fictional detectives make their jobs seem. Instead, there are more than enough opportunities for you to come out looking like a bumbling Inspector Clouseau.

During her distinguished Federal (and post-Federal) career, Roslyn Brown has seen her fair share of investigations that have gone the wrong way. It could be an investigator’s failure to interview certain witnesses, a failure to take a complainant’s statement into account, or, perhaps, an action, such as a widely shared email, that shows a lack of objectivity. An investigator’s failure to stay up to date with case law could sink a case, as could the inability to meet your deadlines.

Over the course of an afternoon, Ms. Brown will provide guidance on how to conduct a timely and effective investigation, while identifying the pitfalls that have doomed such efforts in the past.

Attendees will learn how to:

  • Collect relevant evidence during the investigation.
  • Refine their investigation skills.
  • Identify the pitfalls that that derail effective investigations.

Attendees can also earn up to 3.5 EEO refresher credits by attending this session.

  • Can I attend Virtual Training from my government computer?
    • FELTG uses Zoom to broadcast this Virtual Training Institute event. Many government computers and systems allow Zoom access. If for some reason your firewall will not allow access, you’re welcome to use your personal email address to register, and to attend the sessions from your personal device.
  • Can I earn CLE credits for this class?
    • CLE applications are the responsibility of each attendee; FELTG does not apply for the credits on behalf of attendees.  If you are seeking CLE credit, attendees may use the materials provided by FELTG in submission to your state bar. Attendees may also request a certificate of completion which will contain the number of training hours attended.
  • Can I share my access link with co-workers?
